A recent article in The American Lawyer by Trudy Knockless highlights an emerging trend in legal departments: using data-driven metrics to make more informed decisions when hiring outside counsel for legal work. As Jessica Williams, Director of Legal Operations at FanDuel, noted in a recent webinar, "Over time, as we're uncovering more data about people's qualifications and how well they've done on other matters with our folks, we'll see more and more focus toward the individual."   At Westfleet Advisors, we couldn't agree more with this sentiment. When advising in-house legal teams on litigation finance decisions, we've consistently seen that the individual qualifications, track record, and expertise of a specific partner can be more important than the overall reputation of their law firm. While AmLaw 100 firms certainly have well-deserved reputations, at the end of the day, it's the individual litigator who will be handling your matter and advocating for your company in court.    By leveraging data and metrics about individual attorney performance, as the FanDuel team is doing, in-house legal departments can make more strategic, outcome-focused decisions about which outside partners to entrust with their most important litigation matters.
