Review: Laws Bourbon - Honey Cask and Cognac Foeder Finishes (2023)

Quote: "In the late 1990s, distillers crept back into the market. And, when smaller stills were once again permitted in 2009, it fuelled an explosion in artisanal activity." Wrong. HMCE/HMRC had no power to refuse a rectifier's licence on application and only had the discretion to refuse a distiller's licence where the largest still would be less than 18 hl. HMCE's policy had been to refuse such licence. Such an absolute restriction was unreasonable under public law principles, so I changed the law/policy in 1996 such that a credible application for a distiller's licence with a sound business plan would be given fair consideration by HMCE regardless of still size. A rectifier's licence (such as per the Sipsmith enduring myth) should have just been issued on application. After I left, HMCE staff apparently couldn't read the law or apply their own policy written in the internal manual (originally written by me in book X-1 - Spirits production). The Court of Appeal recently overturned a High Court ruling on the Geographical Indications (GI) Act, ruling that the term 'Prosecco' could be registered, making it exclusive to wines produced in the Prosecco region🗺, and not wines made from the 'Prosecco' grape - which is typically harvested in Australia. GI is part of the Intellectual Property (IP) framework, albeit one less commonly seen. As R&D🔬 efforts see more products being introduced to the market, we might be seeing a shift towards more IP issues in the legal scene. We continue to see both states and the wholesale channel attack and make it harder for consumers to buy direct and producers and other sellers of products in the beverage alcohol business to sell, if you truly want to help educate and not just grumble about how things should modernize, you should sign up with the Craft Wine Association and support their educational efforts. No one else is doing this to help our industry.   If you sit idly just watching, it will be too late.
