The Supreme Court of Pakistan has upheld the SC Practice and Procedure Act, 2023: 1. The Chief Justice of Pakistan (CJP) will no longer hold the authority as the 'master of the roster." 2. There will be the provision for appeals against all decisions made under Article 184(3) (including Suo Moto Cases) 3. There will be no provision for appeals in cases that have already been decided before the enactment of the said law (no retrospective effect). On 8/11/23, the SC of Pakistan ruled that the power of the CJ’s in chambers was limited and does not include summoning, directing registration or investigation of the case. Furthermore, a sitting judge can only pass orders while sitting alone in the chamber. Thus, rendering action taken by former CJ Saqib Nisar illegal and ultra vires the constitution.
