A 2021 emergency fix to the CFTC Whistleblower Program's funding crisis is set to expire at the end of September. The hugely successful program is thus on the brink of collapse, requiring urgent Congressional action. "The CFTC Whistleblower Program cannot become a victim of its own success,” said Stephen M. Kohn, founding partner of Kohn, Kohn & Colapinto. “Congress must act swiftly to save this vital program from financial collapse.”

In 2021, Congress passed an emergency measure to save the CFTC Whistleblower Program from financial collapse. This measure is set to expire at the end of September, threatening to shut down a program which plays a critical role in policing corruption and fraud.

On September 9, the SEC charged seven companies with violating a whistleblower protection rule by, among other things, utilizing agreements which required employees to waive their rights to whistleblower awards. “Ensuring that potential whistleblowers can communicate directly with the Commission is a critical part of the SEC’s oversight mandate,” said Creola Kelly, Chief of the SEC’s Office of the Whistleblower.

On the docket for this triannual meeting is a wide array of pressing human rights issues and KKC is making a showing for whistleblowers! On Wednesday, September 11th, Kohn will be speaking about whistleblower best practices in the Institute for Human Rights’ event “Justice and Reparation for Whistleblowers.” This event will highlight not only the essential role that whistleblowers play in the fight for human rights, but the pressing need for greater whistleblower protections and rewards.
