Understanding and respecting the terms of your Employment Agreement is crucial for both employees and employers. The recent case of Simon Mutonhori, who kept company documents after his dismissal, highlights the importance of this aspect. What can we learn from this article in HRD New Zealand: 1. Confidentiality Matters: The case underscores the significance of keeping confidential company information just that – confidential. Even if information arises from informal initiatives, when generated in a work context, it remains company property. This should remind employees of the need to return such documents upon employment termination. 2. Contractual Obligations: Breaching the express terms of an employment agreement can have legal consequences. In this case, the worker was required to destroy all company materials he possessed, showing that the Employment Relations Authority Te Ratonga Ahumana Taimahi (ERA) takes contract breaches seriously. Employees should be aware of the contractual obligations and the potential consequences of violating them. What should you be aware of: 1. At Onboarding: When starting a new role, ensure a clear understanding of your Employment Agreement. Ask questions if anything is unclear. Maintain a separate folder for work-related documents and keep personal and work materials separate from the beginning. 2. Upon Departure: When leaving a role, meticulously follow the agreement's clauses on returning company property and confidential documents. Review the agreement and seek guidance from your HR department if needed. Ensure you return or delete any company documents to avoid legal issues. 3. Regular Compliance Checks: During your employment, regularly review your practices to ensure you are not inadvertently breaching your agreement. Be mindful of sharing and retaining company information without proper authorisation. Keeping up with CPD ensures our HR consultants, Kate and Nicola remain best placed to support you and your organisation! Last week they both attended the Birketts LLP Employment and Immigration Conference 2023 focusing on resolution and managing workplace conflict. The day began with employment law updates and a Barrister/Judge’s insight into the current Employment Tribunals process. There was an energising and fun key note speech by Christine Armstrong of Armstrong & Partners followed by a delicious lunch (we'd be lying if we didn't recognise this as an important part of any conference!) Breakout sessions after lunch included topics of pre-termination negotiations, workplace investigations, change management and avoiding conflict in performance management. Key learnings from Kate 💡 "A really interesting morning listening to both the employment lawyers updates on up coming legislation and when these are likely to become legislation so that we can properly inform our clients in good time of any changes. Whilst we look to resolve complaints or grievances through mediation, investigations still play a role: it's so important to have clear terms of reference, use an external investigator, have clear, well-drafted reports with evidence based findings. Understanding team and individual dynamics and how those affect individual, team and organisational performance is key, together with understanding what positive performance management looks like in your organisation." Key learnings from Nicola 💡 "Tribunals are so busy, judges want organisations to settle matters as claims are taking years to process through the court. Employers need to consider do they wish to spend years in litigation and related costs. Questions to ask ourselves when dealing with grievances: What is the fear behind this complaint? What politics in the workplace has caused this? And that an employee wants to feel that they matter – they are heard and seen in the workplace." #cpd #hr #mediation #coaching
