The Employment (Allocation of Tips) Act 2023, is expected to come into force 1 July 2024, which is a bit later than originally suggested. The Act will create a legal obligation on employers to allocate all tips, gratuities and service charges to workers, without any deductions, and to ensure these are distributed fairly between workers. The introduction of the Employment (Allocation of Tips) Act 2023 has been delayed slightly. The new legislation will now come into force on 1st October 2024 instead of 1st July 2024. When it does, employers will be required to pass tips on to workers. Employers of businesses where tips are left more than occasionally will be required to have a tipping policy in place, and workers will have the right to request a copy of their tipping record should they believe they are not receiving correct compensation and wish to bring a claim to an employment tribunal. Hospitality business owners should also expect to follow a new statutory Code of Practice when distributing tips. New legislation which will require employers to pay all tips, gratuities and service charges to their staff comes into force in the summer. The new rules are complex and the government has published draft guidance to help employers understand the law and comply with it. We’ve written a short blog about this. #hospitalitysector : Employment (Allocation of Tips) Act 2023 : It has now been confirmed that the Employment (Allocation of Tips) Act 2023 will come into force on 1st October 2024 (it was originally due to come into force on the 1st July. - It will then be a requirement for employers to pass on tips on to workers - Employers will also be required to have regard to a new statutory Code of Practice when distributing tips. The final draft version of this new statutory Code is set out in link below. - Where tips are are routinely given employers will also be required to have a Tipping Policy in place - Workers have a new right to request a copy of their tipping record, in order to support a claim to Employment Tribunal, where they believe they are not receiving tips they should be. #employmentlawuk #wagesandsalaries

GOVERNMENT CONSULTATION: The Government are seeking views on setting up a code of practice for fair and transparent distribution of tips. This consultation closes at 4:30 pm on 22 February 2024 They are consulting on the draft statutory code of practice supporting measures in the Employment (Allocation of Tips) Act 2023. The Act aims to ensure that all tips are passed on to workers without deductions. They are creating a statutory code of practice to guide employers and workers in tipping industries on the fair and transparent allocation and distribution of tips. They are welcome feedback from businesses, workers, customers and other interested parties to ensure this code is as helpful as possible.
