On-Site Consumption: Cannabis Impairment Liability: Cannabis intoxication liability, like liquor liability, is a major concern for businesses such as bars, taverns, and entertainment venues. If these establishments over-serve cannabis products and it leads to harm or loss, the business owner can be legally responsible. THC affects people differently, making it challenging for businesses to manage intoxication risks. To mitigate these risks, cannabis business owners must prioritize risk management by understanding potential liabilities, addressing gaps in insurance coverage, and complying with regulations. Many event insurance policies do not cover cannabis intoxication, similar to their strict rules on alcohol impairment. If the DEA follows through, it will represent a sea change for the legal cannabis industry in the United States and possibly open the door for more banks, financial institutions and credit card processing companies to enter the space.
