Clients are often shocked when we tell them about the possibility of surveillance. The initial reaction of many is “that’s not fair, you can’t spy on people.” Well, you can, actually. If there is no trespassing or engaging the individual on false pretenses, such efforts are typically legal. What you do in the public view is just that, public. The sad reality is that surveillance is used by defendants because it is often effective. It’s effective because plaintiffs sometimes exaggerate their impairments. What’s even sadder is that frequently there is no real need for exaggeration. The real problems are bad enough. Let me share a case study: A few years ago, we had an FTCA case involving a botched shoulder injury. Our experts were quite damning of the VA surgeon. The client claimed he could not raise his arms above shoulder level. He couldn’t carry anything but the lightest bag or box. During his deposition, he showed the assistant U.S. Attorney just how limited he was. I believed him. Coming out of the deposition, I felt like our case had gotten stronger. A few weeks later, the government lawyer took the deposition of our orthopedic surgeon expert. The doctor wasn’t as strong as I would have liked, but he connected all the dots. As I sat there, I thought to myself that it was a good thing we had such compelling testimony from the plaintiff himself. As we were packing up to leave, the government lawyer said he wanted to talk to me. My immediate thought was a happy one, thinking he wanted to discuss settlement. Oh no. The government lawyer opened his computer and cued up a video. There was my client retrieving heavy water bottles (the kind that go on top of a water cooler) out of the back of his car. He hoisted them up on his shoulder and carried them up the stairs to his apartment. After the first two scenes, with a bit of understandable mirth, the lawyer told me that this effort was repeated four more times. We could keep watching, or he could just send it to me. In the end, we fired the client and got out of the case. Are there instances where surveillance is done and it’s misleading or incomplete? Of course, that can happen. Sometimes there are good explanations for what might appear to be an exaggeration. Sometimes the material has been edited in such a way that it creates a false impression. A good lawyer is not going to drop a case based only on one snippet of video. Follow up is always required. On the other hand, if it turns out that the surveillance is, in fact, “real,” then that’s a big problem. The greater issue here is not whether surveillance is right or wrong – fair or unfair. It’s about honesty. If a client is not honest with us and the healthcare providers involved, we don’t really want to do business with that individual. What does one learn from this accident & aftermath: 1. Doctors, lawyers, police, & ofcourse politicians are corrupt to their core. 2. If you are capable enough, own & drive 5-star safety rating 4 wheeler. 3. Don't walk on the side of road; even when one wear a helmet on 2-wheel it wouldn't be enough. That's reality. My personal opinion on that brat, if he is able to drive @ 150 kmph he should be hanged, minor or not. All IT industry professional should WFH. WHEN OUTSIDERS BECOME INSIDERS AND THREATEN A BUSINESS USING MALICIOUS MEANS Nail Salon Owner Sentenced To Prison For Placing Arson Device In Competing Salon - April 25, 2024 Kim Vu admitted in her guilty plea in September 2023 that she conspired to commit malicious destruction via fire. Vu owns her own nail salon. She developed animosity towards individuals at a competing nail salon. Beginning in December 2022 Vu approached her employee about a plot to exact revenge on the competing salon. Vu and her employee, Cierra Bishop eventually discussed the idea of setting the other salon on fire. Bishop began work to design a remote-controlled incendiary device that could start a fire within a small box. The two women frequently texted about the plan, which they referred to as Job 1. Surveillance camera footage shows Bishop and a friend, Makahla Rennick entering the competitor salon. Rennick had made an appointment for a pedicure under the name “Katelynn,” at the direction of Vu for Rennick to get the latest nail appointment she can and to just use another name. Vu was traveling to or already at a property she owned in Virginia to have a ready alibi. During Rennick’s appointment, Bishop entered and exited the salon, looking for a place to plant the device. Eventually, Bishop walked to the restroom area in the rear of the salon and tucked the device under a salon desk before leaving. A salon employee then found the suspected device, which smelled like gasoline. The employee opened the package, seeing that it looked like an explosive device, and took it outside near the salon’s dumpsters. The employee later went back outside to check on the device and noticed that box had begun to catch on fire. Police officers and fire department responded to a call reporting a dumpster fire near the salon. Have really thought long and hard about this post and if I should even post. I know it will be polarizing, I know many will disagree and many will have strong opinions. But it has to be said ,not least so that clients are educated. A 5 day surveillance course - even from a reputable company - does not make a surveillance officer. It provides an oversight of the complexities of what is a highly complex and demanding role. It provides the first brick in that big wall that needs building to become an accomplished and experienced SV officer. 5 days is not enough to properly cover communications, glossary, use of cover, foot, stop and plot, public transport, in close, photography, technical, mobile, mobile stop and plot, evidence recovery, evidential chains, log keeping, statements, disclosure and law. I mention it now and on this platform because there has been an increasing number of posts from properly trained, experienced SV officers struggling to get decent work because they are being priced out of the market by inadequately trained and poorly experienced operatives. As per my many previous posts the client deserves more especially when the product obtained may be needed for judicial proceedings. If it fails at court it is too late to redeploy. The client deserves better but due diligence when selecting a provider is a must. Check training ( see above), check experience ( see above) , check legal compliance and be prepared to pay that little bit more. Here endeth the sermon. And yes........... Here are a few safety tips from your local 911 Dispatcher: - Check you Carbon Monoxide Detectors. Make sure the batteries are working and test the tone. - Wear your helmet. I don't care if you think it's dorky, or you're too old, or it will mess up your hair. A head injury will mess up everything and helmets are one of the simplest ways to give yourself a better chance if you crash on whatever you're riding. And while we're on the subject of preventable injury and giving yourself a better chance, wear your seatbelts too. - Don't let your children chat with strangers online, even if it seems harmless. - There are certain pictures that you should never take of yourself and that you should definitely never send to people. If the picture never exists, you'll never get scammed or exploited online. - Road rage. Don't engage with individuals that violate traffic laws. Give them space and report them to authorities. People who are engaging in road rage are dangerous, don't put yourself at risk. And if you ever feel like you're being followed, drive to your nearest police station. Don't drive home. - Pedestrians, I know it is frustrating when vehicles are not stopping for you and you have to wait before you enter the crosswalk, but please just wait. Cars aren't stopping. Wait for someone to actually see you and actually stop. I'm sorry they're not paying attention. - Drivers, please for the love of all that is good GET OFF YOUR PHONES WHILE DRIVING. And going back to pedestrians, GET OFF YOUR PHONES WHILE CROSSING THE STREET. Let's all be aware of each other and put away our distractions. - If you're battling inner demons that make you want to hurt yourself or others, there is help for you. Your mental health matters.
