Within weeks of the Supreme Court’s decision striking down affirmative action in college admissions last year, Republican attorneys general for 13 states sent a letter to Fortune 100 CEOs condemning their DEI initiatives in the workplace. They threatened to hold companies accountable for “illegal preferences” in employment and contracting practices. Missouri Attorney General Andrew Bailey has made good on that threat by filing the first lawsuit by a state Attorney General against a company for allegedly violating the Missouri Human Rights Act. Bailey asserts that IBM subjects job applicants to unlawful racial and gender quotas and bases employees’ pay and employment statuses on whether they participate in DEI practices that he alleges are discriminatory. #employmentlaw #equalityintheworkplace #affirmativeactiondebate

Notable employment litigation in North Carolina against a MAJOR employer in pushback against DEI policies. I predict confidential settlement, likely after some discovery, whether before or after MSJ filings. Defense counsel will almost certainly file, but depends on fact record if any chance. Such settlement prediction is not unusual, as 99% of employment lawsuits settle and do not go to jury trials. That's this week on AccelPro Employment Law. “The baseline is that lawyers don’t have a lot of background in diversity, equity and inclusion. And not only that, but because so much of DEI involves a person’s lived experiences, people will tokenize someone based on their lived experience and conflate that with acquired knowledge. The easiest example is, this person is a woman, so they know all about structural gender discrimination,” she says. “And that’s simply not accurate. I have a diagram I use in some of my presentations that has to do with lived experiences and acquired knowledge. There’s an overlap, but these are two separate categories of knowledge. “You should never be intimidated by a room that you’re in - you’re in it!” Our guest, Janelle Romero Batra, has this to say in our interview and it's the energy that I want for everyone. She’s right though. We work so hard to get our degrees, to get our jobs, to build careers - we know that we put in the work. So why should we feel like the impostors? This is the level of confidence that we need to be bringing into every room we’re in moving forward. And this week’s guest is going to teach us how she became this confident so that we can be this confident too. After graduating from the 2-year Honors Program at New York Law School, Janelle began her career defending employees who were illegally underpaid by their employers. While she thoroughly enjoyed her work and the clients she served (mostly undocumented immigrants), she sought to expand her knowledge within employment law and began working for a firm that specialized in workplace discrimination and sexual harassment claims. As someone who had personally experienced sexual harassment and stalking while in law school, Janelle took a personal interest in representing workers who had faced similar experiences in the workplace with little to no protections afforded to them. Hundreds of represented employees later, Janelle joined a hiring and payroll startup as the Leader of Labor Affairs and oversaw legal matters relating to labor and employment law, business contracts, and general counseling work as needed. Janelle founded Gen Esq Law to provide quality affordable legal options to small businesses and employees. Through her TikTok educational videos, Janelle continues to dedicate her time and talents to helping make the workplace a more fair, appropriate, and prosperous environment for all. In this week’s episode, Janelle tells all about her life as a Latina in law and how she found herself opening her own practice. As a kid, her father instilled a lot of confidence in herself and her actions. Today she uses the same confidence she’s learned to feel comfortable in every room she’s in and win her cases. The benefits of having a diverse workplace are well established and in the world of business the lack of diversity can have a negative effect on a company’s bottom line, as well as negative social consequences for society’s future. The legal profession, however, has not taken full advantage of the business benefits of diversity and inclusion. Of course, law firm leaders should be focused on the financial health of the firm. But the best leaders are also constantly evolving to develop the best business models to serve the firm’s clients, the firm’s owners and the firm’s employees. Increasing the representation of women and diverse lawyers in a law firm can enhance business as more clients factor in diversity when choosing outside counsel.
