Jeff Chiow, Co-Chair of Greenberg Traurig's Global Government Contracts Practice, kicked off a four-part series with the Public Contracting Institute, LLC (PCI) today that will provide a comprehensive understanding of the options and considerations that go into challenging (or defending) the award of a government contract, i.e. a bid protest.
Part 1 is titled, "Pre-Award Protests: Challenging the “Ground Rules” of a Procurement." This is not a review of cases, but rather a distillation of the legal, procedural, and practical factors that inform the litigation of bid protests.
The course will cover pre-award protests, post-award protests, corrective action and an assortment of special protest topics, including challenges to the award of Other Transaction Agreements, research and development contracts, and state and local bid protests. Decision-makers and practitioners will gain insights to take better-informed actions in bid protests, whether they are filing or defending them.

Barry Benjamin, managing partner of the New York office and chair of Kilpatrick’s Advertising and Marketing group, was honored to participate recently on a panel at the BBB National Program’s National Advertising Division’s 2024 Annual Conference, discussing puffery in advertising. The panel discussed the historical background of puffery and its place in our current legal system, how to distinguish an objective claim from puffery, and how the FTC, courts, and the NAD define and review puffery claims.

Wilmington, NC. November 10, 1898. I grew up in North Carolina and went to school (K-12) and college here. But it wasn't until I was well into adulthood that I learned the significance of this place and date. This was the day that a political coup and massacre of at least 60 Black citizens took place in a city that, after the Civil War ended, had witnessed the rise of a Black middle class that included over 126,000 registered voters, doctors, lawyers, newspaper publishers, educators, and elected government officials. But white citizens and officials, both locally and across the state, who did not approve of this success of Black citizens, plotted for months to overthrow the government, destroy businesses and homes, and murder Black citizens.
Why am I sharing this story here and now? Because history is known to repeat itself. And as a white woman, I feel the need to speak up and remind us all that - in the various forms it takes today - holding people back from realizing their own potential and success is wrong. Our country benefits from the richness of our diversity. I hold this belief in my heart and mind when I go to the ballot box for every election, whether local, regional, state, or national. And I think about what COULD have been in my state if this racist attack had been prevented by people who didn't speak up.
