I had the pleasure this week of listening to leaders from law firms and in-house legal departments discussing the evolving nature of eDiscovery vendor/law firm/in-house relationships and the selection criteria being used to identify new vendor partners. One theme discussed is the increased value of transparency in these relationships – transparency around tool selection, workflow, and budget. Counsel all agreed that it is even better when vendors understand the business needs of those being served. There’s the project work, and then there’s the work of work. Vendors that can provide creativity and solutions that help their customers achieve business goals and be successful in their own organization are going to rise to the top. Having project teams that can bring creativity and business savvy, not just solid technical solutions, requires a mix of the right people, the right structure, and the right culture. In my experience, it means listening to the people on the line doing the work and enabling them to be their best so they can do their best. When organizations provide their people with the right environment, the right people deliver creative, sophisticated, business savvy outcomes.

I'm spending a lot of time these days hands on training LLM models, seeing things from the inside-out as it were. GenAI can certainly help today with legal data problems, but I think there’s still a way to go before there’s a game-changing ROI for using GenAI directly on legal data. There is game-changing ROI, today, for using GenAI on many of the business processes and knowledge transfers that are essential to working on legal data.

Last week’s University of Florida Levin College of Law E-Discovery Conference was packed with insights from judges, litigators, and technologists. I put together my top 8 take aways, which unfortunately do not include the deep-fake video of 3 US presidents teaching differential calculus, which was scary good! Day Two of the 11th Annual UF Law E-Discovery Conference was another fantastic day packed with practical advice. I had to expand to seven take aways today, there was so much great material! A big thank you to the organizers for making it such an easy event to attend virtually. In no special order: 1) You’ll achieve better project outcomes if you flip the EDRM around and start your planning conversations focused on your outcomes – what evidence do you need to win? Go from there back to data sources. 2) When selecting a vendor (partner 😉) it’s wise to value relationships not just price. Efficiencies are built over time. 3) The whole industry would benefit from more QA as opposed to relying solely on QC. 4) Joe Biden, Donald Trump, and Barak Obama are all well versed in differential equations and there’s a video of them giving a polite tutorial on the subject together. Deep fakes are WAY better than just a year ago. 5) GDPR related events, specifically supporting DSARs, is an untapped market for eDiscovery providers. 6) If you’re making objections to the government during an investigation you had best come prepared to meetings with specific objections supported by data. 7) GenAI is absolutely a trust-but-verify tool. There’s a lot of innovation going on regarding deploying it, but by next year’s conference we will be talking about how we go about the discovery of GenAI content and perhaps even the underlying methods of how the models were built. Adding #8) Don't rush past production QC and the time necessary to do it well - there may be 87 steps to it. And for good reason. #UFEDISCO24 #ediscovery #legalAI #legaltech

Great day of sessions at the 11th Annual UF Law E-Discovery Conference today. My top five take-aways, in no particular order: 1) Litigators and investigators need to better understand how emojis work. 2) ESI Protocols are not universally loved. 3) GenAI is apparently on people’s minds. But as a data source? I'm enjoying Bing's chat feature, especially it's ability to search the open web for answers and the citations it provides in its responses. My go to prompt this week? Please create a syllabus introducing new students to the topic of XYZ, with a particular emphasis on ABC and 123. I follow that up with: Please expand each bullet point by adding a 1 paragraph substantive summary of each bullet point topic. If you're looking to get up to speed on a brand new topic, or help a student do so, this is a great accelerator for getting a quick overview of the landscape you're about to embark across. All the caveats about checking sources and formats still apply, but having a near instant framework is a big help to me.

I've been playing with GPT recently and have been impressed with its power and flexibility. Yes, lots of caveats, but none that I think should prevent you from seeing what these LLMs can do for you in specific use cases relevant to your business and daily life. A new favorite prompt of mine: "Please rewrite so it does not sound like it was written by GPT".
