SRA: I’m confused 🫤 For any regulator to earn the respect of those they regulate, they must be consistent and proportionate Let’s look at 2 recent / ongoing stories: 1 a solicitor recorded half an hour of non-chargeable supervision time to a file they were given to audit. They intended to do the work at some point in the future. Therefore, they were wrong to record the time as the work had not yet been done Result = strike-off 2 a solicitor drunkenly drove into another car, fled and did not report himself to the police until some days later Result = small fine 3 Post Office Ltd Horizon scandal The lawyers have all clearly been dishonest at best and corrupt / criminal at worst; in many cases they have admitted this Remember that the SRA usually act with only a feint whiff of wrongdoing - guilty until proven innocent Result here = nothing Can anyone explain this to me? #law #lawyer #lawfirm #solicitor #postoffice #regulation #corruption Nick Gould Brian Rogers FCMI Stephen Larcombe

Just to clarify, the struck off solicitor recorded multiple hours (7 or 8) incorrectly over 14 client files, but it was the half an hour that got him found out. I'm not saying that makes the sanction any more proportionate but the headlines of it being for just 30 minutes of non-billable is a little misleading. "The partner then ran a time-recording report for Mr Nester and contacted the firm’s HR department. It emerged that the solicitor had incorrectly recorded four and a half hours of work on 4 January and three hours on 5 January, on a total of 14 separate client files. My brother in law had a car accident with a solicitor. Following the accident the solicitor issued a claim, stating my brother in law fled the scene (an impossibility as he waited for the recovery vehicle and took heaps of time stamped photos) and that he was on the wrong side of the road (another impossibility as it was a single track road). After reporting the solicitor involved for dishonesty they concluded there was nothing wrong with his conduct. I had the same experience when reporting a solicitor for lying. They actually stated he was simply "advancing his client's position", even though I had provided evidence that what he was alleging (directly to my client) was impossible and he knew this.

Worries me and probably a lot of others in the profession. Allocating time to a file before doing the work is not ideal but isn’t necessary dishonest or something which warrants your career ending. They may have just been trying to be efficient by recording ahead of time whilst they were on the file but got caught up with other things and forgot. Everyone makes simple mistakes, some worse than others. I can’t see a clear reason for the difference in treatment from these three scenarios but there’s definitely something lacking here

Wholeheartedly agree Jay Sahota 🌶🪄💰🕰 .. even a whiff or a spurious allegation are investigated and individual solicitors are put under the microscope causing anxiety, expense and reputational damage.

I assumed it was a heinous amount of hours not 8. What happened to that big collapsed firm you all have to pay for as well?

It is unbelievable and very worrying that nothing has been done. This ruined lives of many in more ways than one. There should be one rule for everyone. However, isn't this with everything in life???
