Today's judgement marks the latest exciting development in a seemingly endless series of announcements, decisions, and news related to the DMA. Sarah Hinck and I have published our summer review on the SCiDA blog. Today was the perfect time for it: 12 months since the first notifications. The first quarter of mandatory compliance, and the first General Court judgement today. We've catalogued everything from the designations, DMA investigations, competition law decisions, and activities across jurisdictions in today's review. We also made a quick reference to the ByteDance judgement, which is a landmark case in terms of providing definitions, setting the standard of proof for gatekeepers, and in endorsing the Commission's approach to regulating. It does not close the door on creative defenses, but it does show it isn't easily swayed by the gatekeeper. Show, don't tell, seems a good shared slogan for both TikTok and the General Court. Important reminder for pubs: Having a comprehensive AI policy doesn't just mean authoring rules for its use — you need to think about how your content may be ingested by AI systems. It may feel too late or inconsequential considering most models have already trained on your data, but trust me, it isn't.
