FWC have released their Bargaining Discovery Research Report. For those interested in the Enterprise Agreement space, this report provides an insight into where the FWC are on EA's, with FWC listing six key findings; 1. Participants had low comprehension of the fundamentals of bargaining and agreement-making. 2. Participants reported heavy reliance upon external support. 3. Participants reported that being a bargaining representative is a highly challenging role. 4. There is a significant under-utilisation of existing Commission resources. 5. With Closing Loopholes No. 2 receiving Royal Assent yesterday, provisions of the Act are now in effect and other provisions will commence in August of this year. Amongst all the changes, for those embarking upon, or in the midst of, enterprise bargaining negotiations, careful thought should be given to the changes made to intractable bargaining declarations, which have taken effect today. These changes, which limit the ability of the Fair Work Commission to issue workplace determinations which reduce existing entitlements in enterprise agreements, will need to be at the forefront of any bargaining strategy. The HSF team will be watching this space closely to assess the impact of these changes on bargaining in the short to medium term but there can be no doubt that the bargaining environment for all businesses is about to change! #industrialrelations #employmentlaw

AFSCME member Walter Moore, a security attendant supervisor at Springfield Hospital Center, shares what passing HB 260/SB 192 and enabling collective bargaining rights for supervisors would mean for him: "As a supervisor without collective bargaining rights, I see every day how we’re impacted by not having a voice and not being able to bargain over our working conditions. Our worksite at Springfield Hospital Center is 400 acres. It’s a lot of ground to cover, and when we don’t have enough staff, we are significantly less safe. The stakes are life and death for us. There have been traumatic attacks while I’ve been here. I’m a strong guy, but when you see a coworker who’s been struck and their face is mangled because they’ve been hit 20 times, and you’re running to reach them from another building, I can’t even tell you how that feels. We know there are basic safety practices and trainings that will keep security attendants, staff, and patients safer - but we need to be able to negotiate and bargain for them. Our next Membership and Outreach Committee spotlight comes from Dr. Jacqueline M. Zalewski, West Chester University of Pennsylvania, who shares that the Department of Labor released a final rule on January 9, 2024 that changes the criteria for classifying independent contractors. This rule goes into effect on March 11, 2024 and rescinds the rule passed in January 2021. The past rule was based on two core factors for determining whether a worker is an employee or independent contractor (control over the work and opportunity for profit or loss), while the new rule includes six factors. In addition to the two factors in the past rule, the new rule includes: the amount of skill and initiative required for the work; the degree of permanence of the working relationship; the worker’s investment in equipment or materials required for the task; and the extent to which the service rendered is an integral part of the employer’s business. A huge win for senior staff in local government! This week, the Hon. Sophie Cotsis, NSW Minister for Industrial Relations, introduced a bill to remove senior staff contracts (except for general managers) in local government, bringing much-needed job security to senior executives working in the industry. With these amendments, senior executives will now have immediate access to rights under the NSW Industrial Relations Act and the Industrial Relations Commission, protecting workers from "no reason" terminations. This win is the result of years of hard-fought campaigning by LGEA, USU and depa members. Not only does it improve job security for our members, but it also strengthens the industry's ability to attract and retain senior professionals and executives. #localgovernment #engineers #professionals #unionwin #unionstrong

The use of AI in higher education is impressive, but let's not forget the real solutions that can make a difference in the lives of admissions and financial aid officers. Many of these professionals are burdened with student debt, renting, and working long hours. Livable wages can help reduce turnover and ensure that these dedicated individuals can continue to provide the best support for students. Using the argument of that these are non-profit schools does not change the fact these worldclass schools are paying livable wages for their staff. #HigherEducation #LivableWages #admission #financialaid
