The Wesbank judgment, which is discussed in Worklaw's latest subscriber newsflash, is useful for clarifying the grounds for review in constructive dismissal cases, and the factors courts and arbitrators will need to consider in deciding whether a resignation amounts to a constructive dismissal. But its real value, we think, lies in what the Court had to say about conflict management and workplace relationships. Using an organisation like Tokiso to assist in facilitating improved workplace relationships, could be invaluable in these types of situations.
The tale in Wesbank, A Division of Firstrand Bank Limited v CCMA & Others, which is the subject of Worklaw's latest subscriber newsflash, is a sad one, caused by a deterioration in workplace relationships over 2 years and ending in the resignation of an employee with key skills, and which was then found to constitute a constructive dismissal. The employee was employed as a specialist fraud and risk investigator for 17 years, before resigning.

The saga of Licience revocation of Heritage Bank by the CBN and NDIC has been a roller coaster of events and emotions. Like a Joke, We the staff of the defunct Heriatge bank have been home for over a month mourning and hoping for that glimmer of hope to materialize soonest for us all. Emotions have fled, tears have been shed, shoulders of our families and friends have been filled with our tears asking what our offense was-A question that probably will never get an answer. We have worked, strived, burned our fingers, taken risks and sometimes offended people and customers to make sure the brand was protected and sustained. To the @Ndic and @CenbankNg, the question still on our lips are numerous; 1. There were yearly Audits carried out in the bank by both CBN, NDIC and external audit firms 2. CBN Staff were working with us for over 2 years, what were they doing? 3. Why was a bridge-bank not an option to the Heritage scenario? 4. How did you let it get to this deteriorating point? 5. Where does the over 3,000 staff go from here? 6. What happens to the numerous relationships you have spoilt in the aspects of our depositors which staff toiled to bring for the sustainance of the institution? The questions are too numerous to ask. The regulators should share a part of this blame and explain to the banking public why it was been lied to that no Nigerian Bank will ever liquidate. In the midst of all these, let us all remain steadfast, positive, strong, courageous and determined to secure a good and better future for the sake of ourselves and our families and friends. I believe that we shall overcome this challenge and it will only make us Stronger. Prepare yourself for the opportunities that lies ahead and be ready to dance to it.

This is a clear example of the statement "there are some things that money can't buy". Spending time with our colleagues at Aresbank, to understand what is that they think that we are doing well, what could be done better, and what is that they miss, is a priority for both myself and Mohamed Alrahebi. The beauty of it is that it does not feel at all like work, it is a really enjoyable break within the daily tasks. Listening to your staff is a must. Giving them the opportunity to speak up and share their thoughts allows you to avoid guessing, and provides you with a first hand priceless roadmap to improving working atmosphere. At the same time, it is refreshing to see that the majority of those shown in the picture are relatively new to the organization, bringing in new ideas and best practices, that can be combined with those that we had already in place.
