Yesterday, the Australian Government released its interim response to the Safe and Responsible AI Consultation Paper. HTI welcomes this important first step towards AI regulation. In its response, the Government recognises that unregulated AI, particularly in high-risk settings, could lead to serious harms for individuals and Australian society. It has committed to considering stronger guardrails to address high-risk AI, including through voluntary standards and legal rules. This is an important milestone – we all stand to benefit from AI, but only when there are clear regulatory safeguards in place. Regulation will help to ensure that Australians are protected and that positive AI innovations can flourish. HTI’s response to the consultation paper called for a comprehensive regulatory reform agenda to be immediately implemented. AI technology is racing ahead, and rapidly changing our society. It is essential that the Government takes this opportunity to act now and get the regulatory settings right. The AI Act is one step closer to becoming law. The EU’s latest brainchild hasn’t been born yet, but close enough to start heading to the proverbial hospital: - Currently under review by the Council, the Act is expected to be adopted soon with no changes to its substance. - With the final hurdle in sight, it's anticipated that the AI Act will become law by this summer. Last week, the government took its first step towards regulating AI. 🤖 In a significant milestone for the legal sector, the UK became one of the first states to sign The Framework Convention on Artificial Intelligence. This is the first-ever international legally binding treaty aimed at ensuring that the use of AI systems are fully consistent with human rights, democracy and the rule of law. EU’s AI Act approved by parliament, as lawmakers warn of more to come Artificial intelligence companies operating in the EU will soon be subject to obligations under the world’s first AI law, after parliamentarians voted through the legislation. Lawmakers in the European Parliament today approved the AI Act, with 523 voting in favor and 46 against, with 49 abstentions. The legislation has “nudged the future of AI in a human-centric direction,” Dragoș Tudorache, one of the two lead European Parliament lawmakers working on the legislation, said yesterday. “We delivered. The EU delivered, no ifs, no buts, no later,” Tudorache said. “These are the rules we have forever attached to the concept of artificial intelligence, the fundamental values that form the basis of our societies.” Today's passage of the law in parliament means the EU will soon be the first jurisdiction to have AI-specific legislation. Today, when the unanimous decision was made to adopt the AI Act at the EU level, I also met with those who are developing the first AI system for which I tried to closely follow the regulation in terms of policies and implementation. I went through the testing procedure under real-life conditions, but in a controlled environment, and it was a success. In the coming period, we will audit the AI system to see what improvements need to be made so that we can move to the next phase in the coming months and it can be launched on the market. However, I realized that the AI Act, with all its exceptions, is more of a start in regulating such AI systems, and much of the responsibility still falls on those who develop the systems. In fact, no, the greater responsibility lies with those who provide legal advice to those who develop such systems. Because, by interpreting the AI Act, you can find a lot of loopholes to escape regulation, but do we really want this? Or do we want to have safe AI systems on the market that affect individual rights and freedoms as little as possible? The plenary vote on AI Act is provisionally scheduled for 10-11 April and will enter into force 20 days after publication and will generally apply after 2 years. The prohibited practices will apply after 6 months and the GPAI obligations will apply after one year.

The King's Speech today is notable for its lack of reference to UK legislation on AI (while the DPDI Bill will continue its passage this session). The House of Commons Select Committee on Science and Technology are quick out of the blocks to raise concern. Is there still an opportunity to tag the AI principles (as per the White Paper) into the DPDI Bill? We'll have to wait for the response to the WP. The gap between UK and EU AI frameworks (and the US with the recent Biden Exec Order) will grow - has the UK missed its current chance to find a proportionate middle way to lead on AI regulation? As the Select Committee notes, there was a real opportunity for a tightly focused AI Bill - to strengthen the UK's existing regulatory regimes for AI. The UK could maintain agility and ensure it does not develop a reputation for fragmented AI regulation. This would still leave gaps on safety issues such as disinformation but such a Bill would have been a good step forward.

Today marks another significant milestone as the EU AI Act officially comes into force! To implement the AI Act and oversee general-purpose AI models, the European AI Office has been established. Active since June and soon to be staffed by over 140 experts in technology, law, policy, and economics, it is ready to tackle the complex challenges of the European AI Act. The institution works closely with EU member states and specialists to establish itself as a global reference point for AI governance. Its main tasks: Gathering information from AI providers, evaluating AI models, and imposing sanctions when necessary. Check out the AI Office´s two calls regarding the development EU´s code of conduct for general-purpose AI models, to be established by April 2025: 🔸Call for expression of interest, inviting AI providers, third-party providers, industry associations, civil society representatives, academia, and independent experts to apply to contribute to the Code of Conduct for General AI. In today's world, AI is becoming an integral part of our daily lives and business processes. With this integration comes the necessity for robust regulation to ensure ethical and safe development, safeguarding the fundamental rights of users. Following its precedent with the GDPR, the European Union has once again taken the lead and passed the comprehensive law on Artificial Intelligence, the European Union Artificial Intelligence Act. I'm pleased to share that Semra Islam and I have collaborated on a comprehensive whitepaper focusing on the EU AI Act. This whitepaper explores key aspects of the EU AI Act, including its risk-based approach and the significant obligations of providers, deployers, importers, and distributors of AI systems. The European Union Artificial Intelligence Act has been passed by the European Parliament. It is a remarkable and historical step towards AI governance which will force all organizations using AI systems (whether you are an AI provider, deployer, importer, or a distributor) to meet certain compliance obligations and eventually protect the fundamental rights of individuals in relation to the use of AI. The EU AI Act applies to providers and deployers of AI systems within the European Union as well as to AI providers and deployers from non-EU countries if the AI system’s output is used within the EU. The EU AI Act has a different set of obligations depending on an entity’s role in relation to the use of AI.
