The Department of Veterans Affairs (VA) routinely denies benefits to service members assigned an “other than honorable” discharge status. Does that practice align with what Congress intended, and with what’s best for veterans and public safety? In a new brief for CCJ’s Veterans Justice Commission, Lumen "Lou" Mulligan, Dean and Professor of Law at the University of Missouri-Kansas City School of Law, analyzes the legislation underlying the VA’s approach, the 1944 GI Bill of Rights. He concludes that the VA’s practice runs contrary to the bill’s plain statutory text and congressional intent, leading to a lifetime denial of benefits for hundreds of thousands of veterans. Veterans with other than honorable discharges accounted for approximately 6% of all discharges over the last 20 years but comprise 18% of all incarcerated veterans. While more research is needed, this disparity suggests that the denial of benefits may contribute to increased criminal behavior among veterans.
