The Queensland Government will introduce the Environmental Protection (Powers and Penalties) and Other Legislation Amendment Bill 2024 following an independent review last year. The proposed changes will give the environmental regulator additional tools to prevent environmental harm before it occurs. They'll ensure operators actively prevent community harm, penalize lawbreakers, and expedite clean up actions. The proposed Bill will redefine environmental 'nuisance' as 'serious or material environmental harm.' This definition equips authorities with more proactive enforcement tools and allows for more fitting penalties, especially for persistent issues like odour. #QueenslandEnvironment

Two decisions which impact multiple sectors were issued by the Supreme Court this week. First, the court stayed implementation of the Good Neighbor Rule which involves reducing emissions from states that are upwind to lower impacts in downwind state. The key provision is centered around EPA being able to write and implent rules if an upwind state doesn't provide reduction. The second ruling is the removal of the Chevron deference which has allowed agencies the ability to provide regulatory interpretation when rules issued by Congress are vague or unclear. This deference has been used across all agencies in the rulemaking process. The impact of removing this capability could have far reaching consequences since it will fall back on Congress to relay what they intended in such circumstances. Much to consider going forward!
The #SupremeCourt ruled on two cases that impact the clean air regulation. On Thursday, the Supreme Court blocked the US Environmental Protection Agency (EPA)’s #GoodNeighborPlan, ruling that the emissions reduction standards set by the plan will likely cause “irreparable harm.” This plan dealt with requiring “upwind” states to reduce air pollution, affecting “downwind” states, where if “upwind” states do not come up with an adequate plan, the EPA will make one for them. The Supreme Court blocked the rule for now while the U.S. Court of Appeals completes its review. Earlier today, the court overturned the legal doctrine known as the #ChevronDefense, which previously allowed judges to defer to federal agencies in cases where the law is ambiguous. This means that the power to determine the best interpretation of the law will reside with judges—not federal agencies. This could make it easier to overturn federal regulations, including those related to #environmentalprotections. ICAC members can find more information about these rulings in their email inboxes.
