A new dawn for wind turbines My colleague John Lancaster helpfully wrote this summary of the changes to planning rules for onshore wind in England that will apply as of today: Part C added to paragraph 158 in favour of repowering existing wind farms and the significant footnote 53a, which introduces new routes to permitting wind turbines. Whilst it doesn’t wholly remove the need to demonstrate community support, which previously meant an effective ban in England, it does relax by changing one word in footnote 54 from “fully” to “appropriately” in the sentence “….the planning impacts identified by the affected local community have been [fully] appropriately addressed and the proposal has their backing” which could be quite a significant breach in the dam. 53a introduces some new measures. Local Development Orders (Local Development Orders | Local Government Association):- “LDOs provide permitted development rights for specified types of development in defined locations. They are flexible and locally determined tools that LPAs can use to help accelerate the delivery of appropriate development in the right places. LDOs can help enable growth by positively and proactively shaping sustainable development in their area. They can play an important role in incentivising development by simplifying the planning process and making investment more attractive. “ And Neighbourhood Development Orders (Community Right to Build - Neighbourhood planning):- “The Localism Act also allows for community organisations to bring forward a ‘community right to build order’ which is a type of neighbourhood development order. This allows certain community organisations to bring forward smaller-scale development on a specific site, without the need for planning permission. This gives communities the freedom to develop, for instance, small-scale housing and other facilities that they want. Any benefit from this development stays within the community to be used for the community's benefit, for example, to maintain affordable housing stock or to provide and maintain local facilities such as playgrounds and village halls. Community right to build orders are subject to a limited number of exclusions, such as proposals needing to fall below certain thresholds so that an Environmental Impact Assessment is not required. Proposals are subject to testing by an independent person and a community referendum.” Whilst it would be preferable if wind wasn’t made a special case in planning policy, an cautiously optimistic thumbs up.
