In claim adjustments, understanding and adhering to local laws is paramount. A recent case illustrated this when a contractor's excavation adversely impacted neighbors. An engineering consultant, appointed by the project owner, quickly deemed the contractor responsible. Acting on this, the previously appointed loss adjusters accepted the consultant's assessment and prepared their report accordingly. However, when reinsurers requested our review, a significant oversight came to light: the consultant had not submitted a mandatory incident report to the municipality's safety committee. This gap in compliance underscored the need for strict adherence to regulations, as the absence of negligence or rule violation can significantly shift liability perspectives. Ensuring proper procedural adherence in every claim isn't just good practice—it's essential for maintaining professional standards.
