CERHA HEMPEL partners Dr. Thomas Trettnak (M&A, Restructuring) and Christoph Reiter (IT/TMT, M&A) also joined this year’s conference and besides the conference itself held various meetings with a number of befriended lawfirms and colleagues active in both the Tech and M&A sector. Both Thomas and Christoph are cautiously optimistic that Europe as a tech hub will be resilient enough and be able to compete on a global scale going forward, thereby offering both capital and know-how for great opportunities in business and investments. At the same time, in particular the EU should curb its overregulation in industries like the tech industry that could suffer as a result.

💡 𝙁𝙞𝙣𝙖𝙡𝙡𝙮 𝙞𝙡𝙡𝙪𝙢𝙞𝙣𝙖𝙩𝙚𝙙?💡 This opinion by AG Emiliou will certainly cause a stir in Brussels. While we're waiting for the actual opinion to be published, the Court's press release is remarkably clear and, in my view, to the point. ✅ 🚨 The Commission's interpretation of Article 22 EUMR cannot stand because "[𝘴]𝘶𝘤𝘩 𝘪𝘯𝘵𝘦𝘳𝘱𝘳𝘦𝘵𝘢𝘵𝘪𝘰𝘯 𝘨𝘪𝘷𝘦𝘴 𝘳𝘪𝘴𝘦, 𝘪𝘯𝘵𝘦𝘳 𝘢𝘭𝘪𝘢, 𝘵𝘰 𝘢 𝘷𝘦𝘳𝘺 𝘴𝘪𝘨𝘯𝘪𝘧𝘪𝘤𝘢𝘯𝘵 𝘦𝘹𝘵𝘦𝘯𝘴𝘪𝘰𝘯 𝘰𝘧 𝘵𝘩𝘦 𝘴𝘤𝘰𝘱𝘦 𝘰𝘧 𝘵𝘩𝘦 𝘔𝘦𝘳𝘨𝘦𝘳 𝘙𝘦𝘨𝘶𝘭𝘢𝘵𝘪𝘰𝘯 𝘢𝘯𝘥 𝘰𝘧 𝘵𝘩𝘦 𝘊𝘰𝘮𝘮𝘪𝘴𝘴𝘪𝘰𝘯’𝘴 𝘫𝘶𝘳𝘪𝘴𝘥𝘪𝘤𝘵𝘪𝘰𝘯. 𝘔𝘰𝘳𝘦𝘰𝘷𝘦𝘳, 𝘵𝘩𝘦 𝘱𝘳𝘰𝘤𝘦𝘥𝘶𝘳𝘦𝘴 𝘵𝘩𝘢𝘵 𝘸𝘰𝘶𝘭𝘥 𝘳𝘦𝘴𝘶𝘭𝘵 𝘧𝘳𝘰𝘮 𝘢 𝘣𝘳𝘰𝘢𝘥 𝘪𝘯𝘵𝘦𝘳𝘱𝘳𝘦𝘵𝘢𝘵𝘪𝘰𝘯 𝘰𝘧 𝘈𝘳𝘵𝘪𝘤𝘭𝘦 22 𝘰𝘧 𝘵𝘩𝘦 𝘔𝘦𝘳𝘨𝘦𝘳 𝘙𝘦𝘨𝘶𝘭𝘢𝘵𝘪𝘰𝘯 𝘸𝘰𝘶𝘭𝘥 𝘩𝘢𝘳𝘥𝘭𝘺 𝘣𝘦 𝘦𝘧𝘧𝘪𝘤𝘪𝘦𝘯𝘵, 𝘱𝘳𝘦𝘥𝘪𝘤𝘵𝘢𝘣𝘭𝘦 𝘢𝘯𝘥 𝘤𝘢𝘱𝘢𝘣𝘭𝘦 𝘰𝘧 𝘦𝘯𝘴𝘶𝘳𝘪𝘯𝘨 𝘭𝘦𝘨𝘢𝘭 𝘤𝘦𝘳𝘵𝘢𝘪𝘯𝘵𝘺 𝘵𝘰 𝘵𝘩𝘦 𝘱𝘢𝘳𝘵𝘪𝘦𝘴." This is what many, including Andreas Mundt and a number of esteemed colleagues such as Rainer Bechtold, Sven Voelcker, Dr. Julian Urban, Dennis Cukurov, and Philipp Otto Neideck, have been arguing for years. If Der Gerichtshof der Europäischen Union follows suit, it will not only put the European Commission's #DGCOMP in an awkward position, but will also reverberate across borders and into broader policy discussions. 🌐 Will we see more #Towercast-style abuse of dominance proceedings to catch below-the-line mergers? Or will there be an overhaul of the #EUMR twenty years after its last reincarnation? 🔄 #Antitrust #MergerControl #LegalDebate #PolicyChange Hogan Lovells Germany

Do you want a new drill, or do you want a hole in the wall? An interesting question that Richard Susskind put forth kicking off the discussion around The Future of Dispute Resolution yesterday at Dublin International Disputes Week . It was a great reminder that as we look for innovation we need to focus on the client’s goal, not simply the tools. The panel continued the conversation with keen observations that there is technology already here and now that can be leveraged (i.e., rapid fact development, timeline summaries, etc.), and that there is more disruption to come over the next couple of decades. A common theme is that we need to focus on what is GOOD ENOUGH. While we should proceed with caution, we cannot let perfection be the enemy of good (progress). #innovation #curiousity #DIDW iDiscovery Solutions Fabrice Likosso
