The Bureau of Land Management (BLM) is proposing increased fees at recreation sites along the Madison River Corridor. Public comments are due by Wednesday, September 18. While aimed at managing the impacts of increased use, these changes impose a "double tax" on commercial users, including outfitters and guides, by adding new fees on top of existing Special Recreation Permit (SRP) costs. BLM justifies this fee structure by claiming that SRP fees cover only administrative expenses for BLM sites. Instead of simply adjusting the policy to allow SRP fees to be used for other expenses, like maintenance and repair, BLM has chosen to implement an additional cost above the SRP fees. This fee stacking could severely impact commercial operations by increasing overall costs and complicating financial planning. They are to be enjoyed AND taken care of by the PUBLIC, the American people. That's you and me and your neighbors, and people living in Utah, Massachusetts, Nebraska, the District of Columbia, on Indigenous Tribal lands and in US territories. The federal agencies are charged with managing them FOR us; our tax dollars, appropriated by Congress, are what provide the funding for them to be taken care of. The more we participate in public processes, where our voices are sought out by the federal land managers, the more say we have in what happens to them. Help others get information and get to the table so they feel heard. Elect officials who want to keep those processes in place, and who believe in funding the stewardship of these places sufficiently. This is how the public will continue to have a say in what happens to #publiclands. If you're a local Utah business owner, don't complain that your lands are getting "locked up." Get involved with your local Bureau of Land Management office--yes, they are local too, not just in DC---and raise your voice, participate in the process. Stop whining that your lands are getting 'taken away.' It's blatantly false. And I really wish #reporters would stop playing up this overtly anti-federal government narrative--it's irresponsible reporting. If you plan to quote that kind of misinformation or paraphrase it in your story, then you are responsible for ALSO including and explaining the facts--and the fact is that these lands belong to each and every individual living in this country.

Fifteen months ago, I posted a long thread on Twitter explaining the Crown Lands problem in Newfoundland and Labrador. It's a serious problem that had been known to the legal profession for years, and one for which lawyers had been asking government to solve. I won't re-write the whole thing here, but I will link to it. https://lnkd.in/eNyrM6XZ To understand the full depth of the problem, I encourage everyone to look at the provincial Land Use Atlas: https://lnkd.in/eQCi_c7p Turn off everything but "Land Use Details" and "Title Details". According to the map, significant portions of major towns are all on what is apparently Crown Land. Bonavista, Harbour Grace, Grand Bank, Placentia, Torbay - even downtown St. John's. That's just a sampling of a long list. Since that thread, the law has come no further ahead. The exact same problems, with the exact same severity, still exist as of today. The end result is mass confusion over what is and is not private property in Newfoundland and Labrador, with serious consequences for housing development and real estate sales. I'm posting this today because the House of Assembly is still in session, but we've had no movement on the matter, nor has the government said anything publicly about its intentions. Will this problem ever be fixed?

New article today about times when the government took property through eminent domain just to create wasteland. Two examples are transportation projects that failed and the third is an IJ case where we are trying to stop a town government from taking property from our clients. Tennessee lawmakers have passed a bill that could prevent these abuses. The legislation would make government prove that the land is being taken for a necessary public use, prove that it will follow through on development, and also prove that it can't just do the same thing by purchasing property from a willing seller. Actually, the idea goes back to feudal Europe, where a King would tax land owners in exchange of protection. The concept has just evolved in modern times, and although it varies from location to location, property taxes provide water and sewer improvements, provide law enforcement, fire protection, education, road and highway construction, libraries, and other services that benefit the community.
