Medicare Part B penalties are also uncommon, but we see them more often than Part A penalties. If you are subject to the Part B penalty, you'll pay an extra 10% for each year you could have signed up for Part B but didn't. Medicare coverage is based on 3 main factors Federal and state laws. National coverage decisions made by Medicare about whether something is covered. Local coverage decisions made by companies in each state that process claims for Medicare. These companies decide whether something is medically necessary and should be covered in their area.

There is a penalty for failure to file Forms 1094-C and 1095-C. These information returns are also subject to the lower electronic filing threshold for 2023. There are opportunities to reduce the penalties through late filing and/or reasonable cause, but the IRS is increasing enforcement efforts in this area. The information return penalties are also separate and apart from penalties under section 4980H for failing to offer health coverage or having minimum essential coverage. These penalties are onerous and there is no separate provision in section 4980H for reasonable cause.
