Pennsylvania Adult Use cannabis legislation may be coming soon as the governor is "sick and tired of losing to friggin' Ohio"! (ouch PSU fans). Some of the actual text from the proposed budget released yesterday: “ This budget recognizes that the time has come for Pennsylvania to legalize adult use cannabis. Every one of Pennsylvania’s neighbors except West Virginia has legalized adult use cannabis, including Ohio. Pennsylvania is currently at a competitive disadvantage, losing out on critical tax revenue and new businesses to our neighbors. Furthermore, Pennsylvania’s overburdened police and courts have more important things to do than arrest and adjudicate people for the use of cannabis. The prohibition of cannabis has also created an underground economy that fuels violence perpetrated by drug traffickers and gangs seeking to control the illicit and dangerous forms of synthetic marijuana in our communities. As such, this budget proposes legalization of adult use cannabis effective July 1, 2024, with sales within Pennsylvania beginning January 1, 2025. And, with the funds generated by the legalization of adult use cannabis, Pennsylvania can right some of the wrongs of those individuals impacted by archaic laws. To that end, the budget proposes to invest $5 million in restorative justice initiatives from adult use cannabis proceeds, in addition to the immediate expungement of the records of those incarcerated for only a possession related offense attributed to cannabis. The adult use cannabis industry in Pennsylvania, as a new potential cash crop for our farmers, will be regulated by the Pennsylvania Department of Agriculture.” There is also a 20% (yes twenty) proposed wholesale tax which seems excessive, although it is wholesale and the devil will be in the details. Pennsylvania Gov. Josh Shapiro said he’s “sick and tired of losing to friggin’ Ohio” during his budget address Feb. 6, when the Democratic executive called on state lawmakers to send an adult-use cannabis legalization bill “to my desk.”

(That's me - waiting to get sworn in for a second term to the Massachusetts Cannabis Advisory Board last Friday.) So happy to have my first meeting as Chair of the Cannabis Industry Subcommittee under my belt, and incredibly grateful to have the amazing Ryan Arias Dominguez, Frank Shaw, Kim Napoli, Commissioner Ashley E. Randle, and Tim Rooney serving alongside me. Our goal for this year is simple – **BE EFFECTIVE**. Our mandate is to study issues and make recommendations to the Cannabis Control Commission, and we already have some great ideas on deck. Common sense recommendations - some that require a little more discussion and some that we hope to make in short order. How do we make access better without sacrificing safety, how we do make it easier to operate a business, how do we improve pathways to equitable industry participation? These questions underpin what we are focused on. MA stakeholders – please don’t hesitate to reach out to me with any suggestions / issues / concerns that you think we should be discussing.
