Bureaucrats who have little to no experience in the trucking industry listening to equally uninformed vocal special interest groups write rules that entirely miss the mark and oftentimes create more problems than they are intended to address. This is the situation with the ELD mandate. There is absolutely no statistically valid evidence that ELDs have in any way reduced truck/driver at fault accidents. The mandate aspect should be eliminated and fleets should remain free to utilize this technology (or not) as a matter of choice. Unnecessary regulation is bad for business and serves no greater public interest. #ELD #FMCSA

Here is the FIRST of three big mistakes attorneys make when settling an injury or death claim caused by a tractor trailer. Failing to identify all of the parties who share responsibility for the wreck can be disastrous. Most attorneys will identify the driver and his or her trucking company. That’s pretty basic. But trucking cases need to be thought of in terms of the entire transportation cycle. So a product leaves a factory, goes through distribution and storage channels, goes to a retailer, then ultimately to a consumer. Some actors are facilitators who operate behind the scenes. Depending on what happened in that cycle, any of those parties may have breached simple legal duties they owe that contributed to the crash. A clear example of this may arise when a freight broker hires a notoriously dangerous motor carrier to ship a load. Although the law is still developing, many jurisdictions will hold that broker legally responsible if the motor carrier then causes a crash. If you are a lawyer who handles these claims, dig deep and investigate thoroughly.
