Effective November 18, 2024, State Driver's Licensing Agencies must remove the CDL privileges of drivers in a “prohibited” status in the Clearinghouse, This will result in a downgraded CDL license until the driver completes the return-to-duty (RTD) process The Clearinghouse-II update also requires the following: SDLAs must query the DOD Drug and Alcohol Clearinghouse before issuing, renewing, upgrading, or transferring CDLs and issuing, renewing, and upgrading CLPs. SDLAs must review a driver’s information when notified by FMCSA of a driver’s Clearinghouse status change. Note: SDLAs with legislative authority currently have the option to voluntarily query the Clearinghouse and downgrade CDLs for prohibited drivers and may do so before the November 18, 2024 compliance date. https://lnkd.in/gAGeUFFE

FAQ: Are CDL drivers who are employed by state government agencies subject to DOT drug and alcohol testing requirements? ✅Yes, Drivers for government agencies who operate vehicles that require aCDL, and are not otherwise exempted in §382.103(d) are subject to DOT drug and alcohol testing. The statutory definition of “employer” for Part 382, applies to any person including the United States, a State or a political subdivision of a State, and the District of Columbia, that owns or leases a commercial motor vehicle or assigns employees to operate a commercial motor vehicle. §382.103(c) specifically provides that the exceptions from certain Federal Motor Carrier Safety Regulations for Federal, State, and local government agencies do not apply to the FMCSA drug and alcohol testing requirements in Part 382.
