🤥 "My 2 months' salary is not credited." Not everyone could dare to share this problem on social media. So, I am here... to address their problem on their behalf. Our team has been receiving several complaints every day that their respective companies are withholding their salaries without any valid and legitimate reason. Employees depend on their salary to pay for daily expenses, EMIs, rent, etc., which is their main source of income. Before joining any company, do proper research if the company has a history of not paying salaries to employees. Here is the process an employee must follow to fight against such practices of companies. 1. Such an employee must communicate the problem to the employer in writing requesting the unpaid wages. (Keep a copy you) 2. If the company says that they will settle unpaid salary, full and final settlement if you resign, DO NOT RESIGN. If you resign, you will lose your right to claim the settlement amount. 3. All your colleagues or a single employee who is not paid salaries can collectively send a legal notice to the company. 4. If the employer still does not respond to the notice, take legal advice from a lawyer and inform the labour commissioner of your state or approach labour court for remedy. For reference pl see case law attached Q2 : How much Gratuity is Paid : It's Paid at the Rate of 30days Gross salary for each completed year of Service ( if service is more than 6 months after 1st year, such service is counted as one year). For BALOCHISTAN ONLY : GRATUITY IS FOR 60 DAYS FOR EACH COMPLETED YEAR OF SERVICE. Q3 : When is to be paid ? At the time of separation with in two days. Q4 : When cannot be paid ? If dismissed on Misconduct after complete inquiry proceedings, Gratuity cannot be paid by law. Q5 : Who will pay the Gratuity. Employer will pay the Gratuity. Q6 : Employer is suffering from losses , can he avoid Gratuity? No , Loss or Profit has nothing to do with Gratuity. Q7 : There is no mention of Gratuity in our Appointment letter ? Answer. Gratuity or PF one of them must be paid even if he fails to mention it on Appointment letter. Q 7.2 : We are on contract ? Yes Gratuity is to be paid on completion of One Year or more Q8 : My employer has no Gratuity policy. Ask him to define policy other wise , he will have to comply law. Q9 : Our HR department is not responding to our emails. Answer: Take them to tea or coffee or lunch or dinner . Invest in them hopefully they will respond to you.
