A few thoughts on Judge Amy Jackson’s June 28 decision with respect to Motion to Dismiss in the SEC v Binance litigation and why it is important for the crypto industry (https://lnkd.in/eXAVyDZG). When you focus solely on the issue of whether a cryptocurrency is a security or not, the Court ruling paints a picture of an uphill battle for Binance, while at the same time containing a silver lining for the exchange and the crypto industry in the form of the dismissal of the SEC’s claims that (1) secondary sales of BNB represent sales of securities, and (2) reserve-backed stablecoin BUSD is an investment contract. #cryptoregulation #cryptolitigation #SEC #Binance #Howey

SEC guidance currently makes it more expensive for US banks to hold digital assets for customers. Designed to provide transparency, this guidance limits the ability of banks to provide cryptocurrency services at scale in practice. Banks are now calling for the SEC to adjust this guidance. In an ideal world, they believe this would look like removing the on-balance sheet requirements whilst maintaining disclosure requirements. #DeFiNews: The SEC has passed new rules extending federal securities laws oversight to cryptocurrency and Decentralized Finance (DeFi) sectors, exempting those with assets under $50 million. The rules require compliance with securities laws for transactions involving crypto assets meeting the definition of securities.
