Utilizing a vignette experiment with a quota-representative sample of UK citizens, we investigate how information on litigation influences preferences for climate measures, including a carbon tax. Surprisingly, our findings reveal no direct link between strategic litigation and policy attitudes. However, the potential for legal cues to affect attitudes in more indirect and cumulative ways remains an interesting avenue for future exploration. 🌊In this article, my colleagues and I summarise the key takeaways from the long-awaited ITLOS Opinion on climate change, and the implications of the Opinion. In short, ITLOS has concluded that anthropogenic (i.e. human-caused) greenhouse gas emissions constitute “pollution of the marine environment” under the United Nations Convention on the Law of the Sea, triggering certain positive obligations of States, including a duty to prevent, reduce and control both land- and sea-based anthropogenic GHGs. The Opinion is the first in a trio of advisory opinions by international courts that will likely be issued within twelve months of each other – next to follow are opinions from the Inter-American Court of Human Rights and the International Court of Justice. ⚖️ Taken together, these opinions, together with the ECHR’s judgment in KlimaSeniorinnen v. Switzerland (which we also analysed in an earlier article) are establishing a normative a normative framework at the international level upon which future international and domestic climate change claims will likely be based. Many companies lulling into complacency that they can delay or outright avoid climate disclosure mandates. Notwithstanding litigation challenges, revenue thresholds, and political sniping, far more companies will have to comply directly or indirectly, and they may already be late to the table! Scholars argue SEC climate rule does not raise First Amendment concerns The brief argues that the climate disclosure rule does not violate the First Amendment and should be evaluated under a deferential standard. A group of First Amendment Legal Scholars supports the SEC's position in the court challenge against its climate rules. The amicus brief, filed by the Knight First Amendment Institute at Columbia University, argues that, as a requirement seeking to inform and protect investors, the climate disclosure rule does not raise First Amendment concerns. At most, the rule should be evaluated under a lenient standard, which it would satisfy because it is not an undue burden on speech (Brief for First Amendment Legal Scholars as Amici Curiae Supporting Respondent, State of Iowa v.
