Amanda C. Stefanatos’ recent article titled, “The ‘Expected or Intended’ Erosion of the Duty to Defend in Opioid Litigation”, was featured in Westlaw Today. Amanda provides detailed analysis of the growing number of courts across the country that have sided with insurers by declining to extend the duty to defend to drug manufacturers for their role in the opioid crisis, including the most recent Ninth Circuit case of AIU Insurance Co. et al. v. McKesson Corp. The article discusses how these cases are eroding the fundamental broad duty to defend, where courts seem to be making both moral and legal determinations contrary to basic insurance law principles. Product liability risk management to be revisited: Get ready for revamped EU rules ⚠ "EU consumers will soon have easier access to compensation for damage caused by defective products." This is how the EU Parliament summarised the outcome of yesterday's adoption of the new product liability directive. And more on the key points: "Easier compensation claims for victims. The updated directive simplifies burden of proof requirements for those claiming compensation and cancels the minimum damage threshold of 500 euro. While the claimant would normally have to prove that the product was defective and its faultiness caused the damage, now a court can presume it is defective, especially in the most technically and scientifically complex cases. The court can also order the business to disclose the “necessary and proportionate” evidence to help victims of damage with their compensation claims. The new rules also allow national consumer protection authorities to provide consumers with additional help." 👉 What may help consumers will put an additional burden on manufacturers. Especially on those with complex products. Inter alia medical devices may fall into this category. ☝ The new rules are thus nearly there. Next important step: Prepare for the new legal framework and think of adopting risk management procedures, insurance coverage, documentation and pre litigation strategies - all to ensure that innovative products will still be brought onto the EU market without risking detrimental damages in case of defects. #lifesciences #healthcare #regulatory #digitalhealth #productliability #productcompliance #medicaldevices #compliance #litigation #cmslaw https://lnkd.in/dUepy8UE

The Chevron decision is set to have a significant impact on health insurance, potentially more than any other sector. Key market segments rely on yearly regulatory updates for technical compliance. It seems that courts might now have the authority to overlook previous regulations, raising questions about the direction of future updates. #HealthInsurance #RegulatoryUpdates #HealthPolicy #ChevronDecision
