The G7 Competition Summit, chaired by Roberto Rustichelli, concluded this morning in Rome at the headquarters of the Italian Competition Authority. The event, which took place behind closed doors on 3 October and 4 October, welcomed antitrust and government delegations from the Group’s seven member countries (Canada, France, Germany, Japan, Italy, the United Kingdom and the United States) and the European Commission, for a total of 35 delegates. The central theme of the two-day meeting was artificial intelligence and related competition issues. The AGCM set up a working group on artificial intelligence and brought a technical paper to the Summit, which formed the basis of the discussion on the first day, focusing on current and future horizon scanning and enforcement activities. The second day focused on policy and regulatory issues. The discussion was prompted by a paper prepared by the OECD examining the interplay of regulatory and enforcement measures taken in different jurisdictions to curb the market power of large platforms. The Summit concluded with a joint statement (Communiqué) on digital competition, underscoring the societal risks posed by the emergence of AI, while also acknowledging the substantial opportunities for innovation and economic growth it presents. ❗ #Whistleblowing tool and #Cartel enforcement: AGCM opens an investigation in the potato crisps market. 🗣️Following a whistleblower's report, the AGCM opened an investigation on Amica Chips and Pata for an alleged anti-competitive agreement concerning the production and marketing of private label potato crisps produced for large retail chains. 👗🛍️Fighting Green Claims in Fast-Fashion Industry: AGCM opens an investigation. 🍀According to the Authority, the promotional messages on the Italian website shein. com concerning the environmental sustainability of Shein branded clothing could be misleading/deceptive. 💻The AGCM has opened an investigation against Dublin based Infinite Styles Services CO Limited, which manages Shein's Italian website, for the possible misleading nature of some of the environmental claims made in the '# SHEINTHEKNOW', 'evoluSHEIN' and 'Social Responsibility' sections of the shein. com website. ♻️ According to the Authority, in the face of growing consumer awareness of the impact of their consumption choices on the environment, the company would seek to convey an image of the production and commercial sustainability of its garments through generic, vague, confusing and/or misleading environmental statements. Even some of the information about 'evoluSHEIN', the clothing collection that the company claims is 'sustainable', could mislead consumers about the amount of 'green' fibres used, while failing to inform them about the non-additional recyclability of the garments. 🏭 Furthermore, Infinite Styles Services CO. Limited also emphasizes in a general way its commitment to the decarbonisation process of its activities, while the targets indicated on its website seem to be contradicted by the significant increase in GHG emissions indicated in Shein's sustainability reports for 2022 and 2023. Panelists: Nuno Cunha Rodrigues, Elisabetta Iossa, Mirta Kapural Chaired by: Pınar Akman Great opportunity to share thoughts and experience with other Antitrust Authorities. Here is a summary of my insights. 🔶 Q1. What have been the most important developments in your jurisdiction in the last year? I talked about the application of our new recent powers in terms of below-threshold mergers and market investigations, emphasizing the role they play in filling enforcing gaps and allowing us to promote innovation. I also discussed the novelties in the new merger form and the creation of the Data Science Unit. 🔶 Q2. What are your Agency’s priorities? We are trying to combine short-term and long-term objectives in the face of a changing world hit by a series of crises. Following our numerous interventions during the period of inflation, using all our tools in the key energy and fuel sectors, we continue to exploit the complementarities between competition and sustainability (see the abuse cases in the e-mobility, bioplastics and waste recycling sectors, and the greenwashing consumer protection cases). Of course, we continue to pursue our priorities in the digital sector with a number of new cases. 🔶 Q3. What do you see as the biggest challenges of the next few years? i) Enforcing competition law effectively, in a world that is getting increasingly complex, will create more tension between ensuring legal certainty and effectiveness, and ii) the challenges posed by the intersection between competition policy and industrial policy. #LCF24

The investigation aims to examine the competitive dynamics of the markets concerned and a number of critical issues that recently have been the subject of public debate. Sanzione di oltre 140 mila euro a Radiotaxi 3570 per inottemperanza. 🚘 L’Autorità aveva diffidato la cooperativa che impedisce ai tassisti soci di destinare la quota della loro capacità produttiva inutilizzata a piattaforme di intermediazione concorrenti nella fornitura di servizi di raccolta e smistamento della domanda di taxi nel Comune di Roma. Si tratta della seconda inottemperanza per Radiotaxi 3570. 🔷 L'AGCM ha accertato l’inottemperanza della cooperativa Radiotaxi 3570 al proprio provvedimento n. 27244/2018 e ha irrogato una sanzione di 140.043,95 euro. L’Antitrust aveva diffidato la società a modificare le clausole statutarie e regolamentari sull’obbligo di non concorrenza a portata assoluta, che impedisce ai tassisti soci di destinare la quota della loro capacità produttiva inutilizzata a piattaforme di intermediazione concorrenti nella fornitura di servizi di raccolta e smistamento della domanda di taxi nel Comune di Roma. Si tratta della seconda inottemperanza per Radiotaxi 3570 che non si è impegnata a riconoscere ai tassisti soci la possibilità di accettare, nei momenti in cui ci sia capacità produttiva eccedente, le chiamate provenienti da piattaforme terze, senza l’intermediazione obbligata della piattaforma proprietaria ItTaxi. 🔸 In particolare, l’Autorità non ha ritenuto idonea la misura grazie alla quale i tassisti di Radiotaxi 3570 avrebbero potuto liberare la capacità produttiva inutilizzata solo a favore delle piattaforme che avessero sottoscritto accordi di interoperabilità con la piattaforma ItTaxi. In questo modo si sarebbe attribuito alla stessa cooperativa la scelta delle piattaforme per le quali i tassisti avrebbero potuto operare, definendone anche le condizioni economiche. Dovrebbero invece essere i singoli tassisti a individuare direttamente le piattaforme di intermediazione cui rendere disponibile la propria capacità eccedente. Solo in questo modo possono essere garantite, infatti, adeguate condizioni di apertura del mercato dei servizi di intermediazione della domanda di taxi alla concorrenza di altre piattaforme. 🔹 Considerati il perdurare dell’infrazione e la pervicace inottemperanza alla diffida, l’Autorità ha anche imposto una penalità di mora per 214,40 euro al giorno (da calcolarsi fino al giorno dell’ottemperanza) ai sensi dell’articolo 15, comma 2- bis, lettera a), legge n. 287/1990. https://lnkd.in/dk-yAfzv
