Yesterday I had the pleasure to discuss Pay or Consent models at the EDPS event. During my contribution, I shared: 1️⃣ How these models impact and affect people in their daily lives. Firstly, by explaining their incompatibility with fundamental rights and then by exploring the three levels of harm that people have to endure (both individually and collectively). 2️⃣ I also shared reflections on the sufficiency of cooperation and enforcement mechanisms under the GDPR (and to some extent the DMA) in ensuring digital rights and in addressing these dangerous models. Finally, I mentioned the pressing need to use the right narrative for this discussion. Thanks to all the panelists who enriched the discussion! Press conference on CSDDD just finished - Lara Wolters (rapporteur) found very clear words. My summary and key take-aways of the discussion: 1️⃣ Is the CSDDD off the table? No, it is not. Policy makers are still working on trying to push the Directive across the finish line before the elections. This is difficult and uncertain, but not impossible. 2️⃣ The irresponsible behaviour of a minority of companies and some member states reflect a flagrant disregard of the European Parliament and democratic decision-making within Europe. Such behaviour significantly undermines trust in trilogue agreements and established good practices. 3️⃣ Clarity is needed on where exactly the Council stands vis-a-vis the CSDDD. Right now this is very unclear and all we are seeing is political gaming. So far, there is no concrete proposal from the Council that would make specific suggestions or would present any solutions. 4️⃣ The French suggestion of a new threshold that was made public earlier today (5000 employees instead of 500) does not reflect any formal proposal. 5000 is a number that is astronomically high and it would further undercut the relevance of the CSDDD (which only covers 1% of all European companies in any case). #csddd, #humanrights, #duediligence

Corporate Sustainability Due Diligence directive (CSDD): "Companies will be required to undertake due diligence to identify, where necessary also prevent or mitigate potential adverse impacts, and to end adverse impacts of their activities. Such adverse activities include slavery, child labor, labor exploitation, environmental degradation, pollution, and biodiversity loss". On 7 February, 2024, negotiators from the Parliament and the Council reached a provisional deal on an amendment to the Corporate Sustainability Reporting Directive (CSRD) delaying the adoption of sector-specific standards by two years. The original CSRD mandated the Commission to adopt the second set of European Sustainability Reporting Standards (ESRS) concerning sector-specific information including transport by June 2024. The text agreed by the co-legislators postpones the adoption of the new standards to 30 June 2026. This will allow companies to focus on the implementation of the first set of ESRS. It will also allow more time to develop sector-specific sustainability standards as well as standards for specific third-country companies. The date of application for third country companies will remain the financial year 2028, as set out in the CSRD.
