The Counsel for Justice Award recognizes a counsel who demonstrates an exemplary commitment to serving in-need communities and advancing critical causes. We are thrilled to present it to New York counsel Abigail Everdell.
Abigail's pro bono commitment has long been evident across her practice. Most recently, she helped represent five photojournalists who were assaulted and arrested for newsgathering during the 2020 George Floyd protests. Her work on this important civil rights litigation against the NYPD led the Davis Wright Tremaine LLP team to achieve a landmark settlement requiring the NYPD to implement significant changes to its policies on the treatment of journalists and adequately train officers on those policies, protecting First Amendment interests that are vital to our democracy.

As a scholar in the field of criminal justice, I often come across deeply disturbing content. This material is often so shocking that it tends to elevate my blood pressure, and I fear it may contribute to a premature death. The infamous boxing promoter, Don King, once said, “only in America.” It’s hard to believe he was referring solely to his financial gains. Consider Atlanta, situated in a region where more than half of the Black American population reside. Constituting around 12-14% of the total US population, Blacks are most likely to live in the South. A law enforcement officer in Atlanta bragged about beating a Black individual and charging him in a way that would take away his voting rights. He also admitted to using charging techniques that would result in felony charges designed to disenfranchise Black voters. It was not that long ago when Blacks were beaten and hanged for attempting to vote in the south. However, let’s not misconstrue this as an isolated incident or merely another case of a rogue cop tarnishing the reputation of the majority of law enforcement.
This is a systemic issue that has defined the US criminal justice system for over 150 years, dating back to the implementation of the Black Codes, which were designed to force Africans back into a state of servitude. This is precisely why I advocate for reparations and repatriation from the federal government. If anyone believes that African Americans will one day overcome more than a century and a half of criminalization, dehumanization, and systemic violence, I urge them to wake up. The Black Lives Matter movement was merely stating an obvious truth, yet its supporters were doxed, demonized, and criminalized. The term “Woke,” which originally referred to Blacks being aware and alert of the systemic racism that has permeated the United States since the end of Reconstruction, has been co-opted as a symbol for hard-left politics.
The resurgence of the KKK and the maturation of Jim Crow’s children, who are now wealthier and more cunning than their predecessors, is alarming. The KKK’s presence can be felt in the US Congress, federal government, law enforcement, and beyond. Their authorization to act as they please stems from the criminalization of Blacks. The proportion of Blacks being criminalized is so high that it is genocidal in nature. This is the outrageous reality that we need to know for our survival.

Law enforcement is well aware of this case. It is time the public and people elected to lead take the time to understand exactly what is the law of the land.
The words of Chief Justice William Rehnquist can still be heard loud and clear today, 25 years after the Graham v. Connor decision. And every American law enforcement officer should know them well.
"The reasonableness of a particular use of force must be judged from the perspective of a reasonable officer on the scene, rather than with the 20/20 vision of hindsight. The calculus of reasonableness must embody allowance for the fact that police officers are often forced to make split-second judgments—in circumstances that are tense, uncertain and rapidly evolving—about the amount of force that is necessary in a particular situation. The test of reasonableness is not capable of precise definition or mechanical application."
Our society would benefit from listening to Rehnquist's opinion rather than listening to community activists, protesters, or ill-informed politicians who see issues in black and white instead of seeing the issues from the standpoint of objective reasonableness
