The bench stated that commercial transactions are driven by harsh realities, and the principle of universal brotherhood does not apply. Interesting point raised by Anuja Mandekar and her request to me to address this issue in a post. Also first time I am doing this, but happy that we can inspire each other to share knowledge and questions and opinions on all things legal. Her interest was piqued on the issue of various city and place name changes by the governements and whether it has any legal implications. For instance, does changing the name of Gurgaon to Gurugram, create an issue if the jurisdiction in a contract is written as the old name Gurgaon? Would the parties need to amend the contract for it to be enforceable in Gurgaon/Gurugram? I would consider this not to be an issue on the grounds that the intent of the parties can be made out even if Gurgaon is written. It will most certainly not be confused with Mumbai or Chennai. So the courts would give effect to the jurisdiction as Gurgaon itself. Further, various courts like Madras, Bombay and Calcutta, have themselves not changed their names, so I doubt they will have any concerns with the name changes. 😃 #namechange #jurisdiction #courts Arthavat Law Offices

If Negotiations fail, it is necessary to seek the assistance of a neutral third party or several neutral third parties to reach a solution. How is a dispute resolved by Negotiation Negotiation bargaining is a process in which both the parties cooperate and seek a solution that is mutually beneficial (a win-win solution or co-operative bargaining). It can also be confronting when each side seeks to prevail over the other. If Negotiation succeeds, the parties sign a settlement agreement incorporating the terms and conditions of the agreement or they can simply enforce the agreement.
