Just published this in EJIL: Talk! on the ICJ's Advisory Opinion and the standard of proof for finding apartheid: "... regarding security specifically as a plausible purpose of the inhumane and discriminatory acts [the actus reus of apartheid], security is a broad notion that has notoriously been used to justify heinous crimes, including genocide (see Jonathan Maynard, 2022; Dirk Moses, 2021). In the words of Dirk Moses, “security and self-defense imperatives have authorized Western conquest and occupation for half a millennium,” (Dirk Moses, 2017, p. 382). Because security is generally accepted as a legitimate aim of any state, it is easy to use it as a pretext, effectively precluding any specific intent. Judge Tladi addressed this directly, stating “that security interests as such, no matter how serious or legitimate, cannot override rules of international law…” (para. 44)."

02. Opposites Page 11 When we judge, critique and condemn the opposite polarity (either in us or in another), we have given birth to the opposite, it begins to breathe. We have now begun to operate from ’the’ diabolic split. Page 14 The split dates back to the first time when the unwanted, unbearable was experienced by the psyche; and as a defence, as protection and as its survival the split was created. It was created just so that no-one ever sees the real self, which it now considers not-enough, alone, damaged, helpless, hopeless….. Page 14 last para If we do not learn to integrate these scattered components, then these scattered components learn to accommodate the opposition, ‘now’ it is only a matter-of-time that we become the opposite!!
