Plan committees that have been granted the authority to amend the plan decide to do so solely for the benefit of the plan sponsor without regard to acting in the best interests of plan participants. As a result, any costs associated with such decisions—e.g., implementing automatic enrollment or automatic escalation, or increasing the matching contribution—and with preparing the amendment may not be paid from plan assets. On the other hand, costs associated with legally required amendments may be borne by the plan.   Once the plan has been amended, making sure it is administered in accordance with the new terms does become an ERISA fiduciary responsibility. Plan committees should work with their human resource colleagues and third-party administrator to get the amended terms implemented properly.   As a starting point, it is important to confirm that the TPA understands and can fully execute the plan amendment.
