Fault-based divorce is a divorce that can be granted when one spouse can prove that the other spouse’s actions or behavior were the primary reason for the marriage’s failure. One of those grounds is adultery. If you’re the one who has an affair and the affair led to the end of your marriage, you can be barred from receiving alimony from your spouse. A prenuptial agreement is made before marriage and specifies each spouse's rights to property and assets if a divorce occurs, offering a clear road map during uncertain times. They can be amended during the marriage as circumstances change. People often ask, "Why do I need a prenup? Isn't that like planning that the marriage is going to end by divorce?" The answer is no. Most prenuptial agreements never get use because the couple stay married. They are there just in case a divorce happens. The easiest explanation as to why to get a prenuptial agreement is that you should do it for the same reasons that you execute a Last Will and Testament. If you die without a Will then the government says who gets your stuff and how much they get; even if that wasn't what you wanted. The same applies to a divorce. Without a prenuptial agreement, the government says how to divide up the martial estate. You also don't need to have a lot of assets or property in order to get a prenuptial agreement. You may not have that stuff now, but you may have it in the future.
