The landscape of labor law continues to evolve, and recent developments from the National Labor Relations Board (NLRB) highlight this dynamic shift. In the General Motors decision, the NLRB adopted the Wright Line standard, marking a significant change in how employee misconduct and protected activities are assessed. This new standard requires the NLRB General Counsel to prove that protected activity was a motivating factor in any disciplinary action. If proven, the employer must then demonstrate that the same action would have been taken regardless of the protected activity. This move aimed to modernize workplace standards and align with antidiscrimination laws. However, the 5th U.S. Circuit Court of Appeals recently ruled that the NLRB overstepped its authority in the Lion Elastomers case by attempting to change its interpretation of misconduct protection through a court proceeding. "At Volkswagen – IN JUST A WEEK -- over 1,000 workers have signed union authorization cards. Volkswagen workers are on fire and are inspiring workers all across the country. Fearing all of the momentum they are seeing, VW management has lashed out. When Dave Gleeson went with a group of his coworkers to hand out flyers by one of the plant gates, management sent security guards to kick them out of the area and stop them from handing them out. Volkswagen management has tried to scare workers from talking about the union in the plant and they even confiscated pro-UAW flyers in the break room, telling workers they weren’t allowed to pass out pro-union materials. Volkswagen has even gone so far as to start each shift by having front line supervisors hold quick captive audience meetings where they read out anti-union talking points. Volkswagen’s union busting is disgusting. It’s also illegal. They are the third company we have filed Unfair Labor Practice charges against this morning. Management at Volkswagen recently told folks to reach out to HR if they have any questions about any of this. They said folks should email [email protected]. I know I have questions. Like why does Volkswagen claim to be neutral while holding anti-union captive audience meetings at the start of every shift? Again, that’s [email protected] if you have any questions for Volkswagen management about what they’re doing over there. Our message to workers everywhere is simple: the UAW has got your back. And our message to the companies is clear: an attack on a worker anywhere is an attack on workers everywhere. If you come after one autoworker, you are coming after all autoworkers. Types of industrial relations disputes include disputes over rights, interests, termination of employment, and inter-union conflicts within a single company. The Industrial Relations Court is a specialized court empowered to examine, adjudicate, and render judgments on industrial relations disputes. The duties and authorities of the Industrial Relations Court include examining and adjudicating disputes over rights at the initial level, disputes over interests at both the initial and final levels, disputes over termination of employment at the initial level, as well as disputes between workers' unions within a single company at both the initial and final levels. The procedural law applicable in the Industrial Relations Court is the Civil Procedure Law applicable in the courts within the General Judiciary.

Have you heard about #bumping? It can take place either vertically or horizontally. Horizontal bumping is a transfer of an employee to a position of similar status, conditions of employment and remuneration. Vertical bumping refers to a transfer to a position with less favourable status, conditions of employment and remuneration. Bumping usually takes place when a position of an employee who has been employed for a long period has become redundant and that employee displaces another employee who has been employed for a shorter period. An employee whose position has become redundant may refuse an offer of vertical bumping during consultations. This may lead to the employee being #dismissed and depending on the specific merits of each case, the dismissal may be found to be substantively and procedurally fair.
