All employees in the state industrial relations system now have an entitlement to 10 days’ paid family and domestic violence leave (FDV leave). This entitlement, which commenced on 9 September 2024, comes from the National Employment Standards in the federal Fair Work Act 2009. This new FDV leave entitlement is in addition to the minimum five days’ unpaid family and domestic violence leave already available to all employees in the state industrial relations system under the Minimum Conditions of Employment Act 1993. Why is it that every time a workers compensation scheme hits financial difficulties workers benefits have to be reduced? These deforms are an attack on benefits and rights that have existed for many years. Why too must psychiatric injuries be treated differently. I could never understand the logic. If my employer asks me to stack 5 kg boxes on a pallet that is surely reasonable management action yet if injure myself physically I get compensation. A similar reasonable request that causes psychological injury does not entitle me to compensation. It is time lawmakers looked elsewhere for savings. There are plenty of savings to be made without attacking injured workers benefits.
The Parliament of Victoria’s Legislative Council Economy and Infrastructure Committee is currently conducting an inquiry into the Workplace Injury Rehabilitation and Compensation Amendment (WorkCover Scheme Modernisation) Bill 2023. The ALA supports a financially-sound workers’ compensation system for Victoria, one that adequately provides for those injured at work. As such, the ALA has maintained that the proposed revisions to Victoria’s workers’ compensation scheme will strip too many rights from injured workers.
