For a government contractor or grant awardee, suspension or debarment can be a organizational death sentence. Currently different sets of rules govern the suspension/debarment process for different types of entities. The FAR Council has now proposed updated regulations to harmonize those differences. If successful, this should provide greater certainty and ability to navigate the suspension and debarment process for those faced with prospect of this type of action. https://lnkd.in/gggNiivY

The rule change is coming!   FRCP rule 702 that is.   In 10 days, on December 1, the amended rule 702 governing expert witnesses will go into effect.   This change clarifies a judge’s role as gatekeeper for expert testimony – a judge must FIRST determine if evidence is admissible. If, and only if it is admissible, should the jury hear it, at which time they can decide how much weight to give it.   The misapplication of rule 702 is entrenched and widespread. It will take effort from lawyers to educate judges about this change.   #civilprocedure #litigation #iadc

Proposed New US Litigation [Funding] Transparency Act 2024... "A Bill, To amend title 28, United States Code [re: court organization, see: https://lnkd.in/e4PfAupu ] to provide for transparency and oversight of third-party beneficiaries [typically 3rd party funders] in civil actions..." ‘‘(a) IN GENERAL.—In any civil action, a party or any counsel of record for a party shall— ‘‘(1) disclose in writing to the court and all other named parties to the civil action the identity of any commercial enterprise (other than counsel of record) that has a right to receive any payment that is contingent on the outcome of the civil action or a group of actions of which the civil action is a part; and ‘‘(2) produce to the court and each other named party to the civil action, for inspection and copying, except as otherwise stipulated or ordered by the court, any agreement creating a contingent right referred to in paragraph (1)..."
