It is a struggle to narrow the focus of the case. In law school, we are taught to issue spot. We get rewarded for identifying more issues and delivering more options. When it comes to jury trials, less is more. Jurors get confused by all the collateral issues. Spend the time to understand the core issue in the case. Do away with the rest. Have courage to trust the “right” issue will drive the verdict. I believe the best trial lawyers have the courage to cut out about 80% of the relevant issues and focus the case on the remaining 20%.
