When you're the first legal hire at a company, there's probably already some kind of HR function in place. But figuring out how to engage with HR can be tricky, particularly if you don't have much exposure to employment law. HR wears many hats: recruiting, performance management, learning and development, pay and benefits, and employee relations, among others. Legal should play a role in supporting these functions. Some, like employee relations and pay (wage and hour), may have a more obvious connection to Legal. But even areas like recruiting, benefits and performance management can carry risks that are worth a look from Legal. If you’re not sure how to start engaging with HR about these issues, here are some questions to get you started: 1. What keeps you up at night? 2. Are there any unwritten policies that are not in the handbook or that I should be aware of? 3. What's your process for addressing employee complaints? 4. How have you worked with lawyers in the past? 5. Do you have any ideas about how we might be able to best work together? 6. If money were no object, what would be on your wish list for our HR team? What else?

What do I need to do?” are all questions managers ask when an Employee Relations case starts to hit the skids. “Wait a minute, I’ll go ask a lawyer” doesn’t buy HR any credibility. While the expert is often needed at some point, the People generalist can be reasonably expected to triage the case in real time and explain the legal environment.
