The Tyranny of Technical Specialists as the FTC rules to ban the use of noncompete agreements The United States, having learned nothing, continues to empower bureaucracies to make decisions that should be reserved for the courts or for the legislature. This is an interesting case because I happen to agree with the finding - that working people should not be bound by harsh noncompete agreements. There are 30 million people in the United States bound by noncompetes and it is a burden to work for a company that uses them. It is an overreach. Executives of course should be governed by them and they are specifically exempted. But it is completely out of line for the Federal Trade Commission to create a ruling that has the force of law. That was also the point of view of the 2 commissioners who voted against the policy in a 3-2 partisan vote. I went and found my copy of Imprimis from March / April 2020. In it Larry Arnn, the President of Hillsdale College was reflecting on the abrogation of our rights by unelected bureaucrats and technical specialists suddenly empowered to make broad rulings though their area of expertise was in fact narrow. The legislature we sent to represent us acted powerless in the face of the agents of the state they were in fact sent to direct and govern. He went on to highlight a quote from Winston Churchill: “Winston Churchill wrote grave warnings in 1936, as Hitler consolidated his power. His calls for rearmament were not sufficiently heeded to prevent the worst war in history. He warned that heavy sacrifices were necessary and justified to prevent Hitler from dominating the world. Amidst these warnings, in that same year, he took time to sound a different note in an essay entitled, “What Good’s a Constitution?” “ [W]e must not be led into adopting for ourselves the evils of war in time of peace upon any pretext whatever. The word ‘civilization’ means not only peace by the nonregimentation of the people such as is required in war. Civilization means that officials and authorities, whether uniformed or not, whether armed or not, are made to realize that they are servants and not masters. Socialism or overweening State life, whether in peace or war, is only sharing miseries and not blessings. Every self-respecting citizen in every country must be on his guard lest the rulers demand of him in time of peace sacrifices only tolerable in a period of war for national self-preservation.” Our Federal state now seems to be entirely captive to its own beauruas and agencies. The FTC, though the ruling seems right to me, is entirely wrong to pass a rule of this nature at all. The FTC's noncompete ban is now blocked! Yesterday a Texas federal court enjoined enforcement of the ban nationwide. I bet a lot of you disagree, but I am thrilled about the recent ban of #noncompete agreements by the FTC. Yes. Noncompetes are useful to businesses, OBVIOUSLY. But they are harmful to talent. Restrictive of new enterprise and depressing as fuck. I have never signed a noncompete agreement because I refuse to be held back from adding value to the world, but also I've been able to make that choice since I work so much for myself or as a consultant. The one instance I can see supporting them is in instances of a company sale—obviously it's unideal for the founders to immediately start competing companies... however it's a free market. What do you think about the new noncompete law?
