Delighted to share my latest article on the 'sanctions' imposed by the Court of Arbitration for Sport (CAS) against Russian football clubs following the brutal Russian invasion of Ukraine. CAS relied very little on obvious contractual considerations, chiefly force majeure. The measures imposed may be viewed as as sui generis private sanctions. The article was published in the latest issue of the Cardozo Arts and Entertainment Law Journal. #sportslaw #arbitration https://lnkd.in/dTc7MvAw

The EU has included football in its #AML regulation, which will require professional clubs, agents, and associations to apply strict #DueDiligence measures, regarding #MoneyLaundering risks in particular. Given the amount of money involved with the sport, as well as some recent corruption scandals, it was only a matter of time until the EU took this step. And with several clubs throughout Europe owned by Russian oligarchs, it’s clear that football is a very sensitive area in the current world of #Sanctions. Unfortunately, the UK did not join the movement yet, despite the vast sums of money handled by its Premier League and its immense global popularity, but I hope that will change in the near future. What do you think about this EU move? https://lnkd.in/eXPTyWMB

Ground intelligence gathering remains the most valuable asset to address this evergrowing phenomenon in the Sporting Industry, this is the basics of criminal investigation. The two most valuable ingredients complementing these results are investing in educational awareness coupled with the correct dose of deterrence by imposing solid sanctions.

Sociology - Researcher on match-fixing, sports corruption, organized crime, llegal betting and sport integrity
How are match-fixing criminal networks structured and organised? What elements characterised the power and domination relationships governing the match-fixing practices in Portuguese professional football? What comparisons can be made with other betting related match-fixing networks? The answer to these questions can be found in my latest research published with @SpringerNature in Trends in Organised Crime, in which I examine the "Jogo Duplo" (Double Game) prosecution order, the first and thus far the only Portuguese betting related match-fixing case tried in court. The Safeguard Sport from Corruption event took place on December 11 at the Conference of the States Parties to the United Nations Convention (UNCAC) being held in Atlanta through December 15. The International Olympic Committee – IOC was recognized for their work involving #sportsintegrity. Of note, the IOC, INTERPOL, and United Nations Office on Drugs and Crime released the collaborative -- *Guide on the Investigation of Cases of Competition Manipulation -- at the event. Copy of the must-read *Guide: https://lnkd.in/ehs9TQDE "The exponential growth of the #sportsbusiness market, extensive #media coverage and the global growth of real-time #onlinebetting have created an environment in which many individuals and organizations have a direct or indirect financial interest in the course or the outcome of sports competitions. Such an environment can incentivise those seeking to exploit sport for illicit gain. The nature of competition manipulation involves criminal acts that are not unique to sport, including #fraud and #moneylaundering as well as the involvement of #organizedcrime." - Excerpt from Guide's Introduction #matchfixing #antidoping #sportslaw #gambling #dataprotection #tech

Collaboration between public and private sectors is vital for enhancing security of staff, port, business resilience as well as increasing port deterrent. Also it is a proven intitiaior for enhancing communication, information and knowledge sharing, enables earlier detection of changed tactics of OCGs and builds strong networks. An element of this which as been very successful I UK Ports is that of awareness training to frontline security teams, customer facing staff and Stevedores. Never underestimate the power of collaboration. #NUTPOC #invisibletraffick

Interesting launch of the European #Ports Alliance Public-Private Partnership - starting in Antwerp, Rotterdam and Hamburg to facilitate the fight against #organisedcrime and #drugtrafficking. Willingness and effort to comply is one of the key lessons from the Sportsbet enforceable undertaking provided to AUSTRAC. Within the undertaking, AUSTRAC acknowledges Sportsbet's commitment to remediating AML/CTF compliance issues and work undertaken on an 'extensive remediation program'. Willingness and effort to comply is one of the key considerations of AUSTRAC when determining whether and what enforcement action is the most appropriate response for AML/CTF compliance failings. This is acknowledged in 'AUSTRAC's Approach to Regulation' document.
