#Legalupdate: The Supreme Court's recent ruling on homeless camps was important for #localgov, but it isn't the end of litigation on this issue. The next wrinkle: can zoning laws that prohibit a church from allowing homeless to camp on their property violate the 1st Amendment protection for religious expression? Last week, Manitoba agreed to pay $530 million to children in the care of Manitoba’s child and family services (CFS) agencies to resolve a long running dispute over the Children's Special Allowance (CSA). The CSA is a federal benefit paid to CFS agencies that is to be used for the care, education, training, and advancement of children in care. For 14 years, Manitoba forced CFS agencies to pay over $335 million in CSA benefits to Manitoba, leaving the agencies grossly underfunded and depriving vulnerable children of much-needed resources. In 2022, the Manitoba Court of King’s Bench declared Manitoba’s actions unconstitutional. Three class actions were subsequently commenced to recover damages for the children affected by Manitoba's action, including a class action specifically for children in the care of Métis CFS agencies. The settlement with Manitoba, once approved by the Court, will settle all three class actions. Niklas Holmberg and I, together with Murray Trachtenberg and Genevieve Y. Benoit, had the great privilege to act for the plaintiffs in the Métis CFS agencies class action – the representative plaintiffs, René Lafontaine and Mary Derendorf; the Métis CFS agencies, Métis Child, Family and Community Services and Michif Child & Family Services; and the Métis Child and Family Services Authority. The Métis CFS Agencies and the Métis Authority operate under the auspices of the Manitoba Métis Federation, the national government of the Red River Métis. $84,800,000 will be paid to settle the Métis CFS agencies class action. It is an outstanding result that holds Manitoba accountable for a truly egregious course of conduct, and that will provide meaningful compensation for some of the most vulnerable members of society. So, what does the King’s Speech 2024 tell us about plans to tackle ASB? I attach a document with the extract from the briefing notes which relates to the Crime and Policing Bill. The headliners: 👉 Rebuilding Neighbourhood Policing 👉 Introducing a Respect Order to deal with persistent adult offenders 👉 Fast tracking Public Spaces Protection Orders to deal with street drinking 👉 New powers to tackle off-road biking 👉 Create a duty on partners to work together to tackle ASB 👉 Duty to have ASB lead in each Local Authority area There are other Bills proposed which impact on ASB too: ✔️ Victim, Courts and Public Protection Bill - reference is made to support and rights for victims of crime AND anti-social behaviour ✔️ Renters Rights Bill - abolishing the s21 eviction process I have thoughts (incoming!), but the main one for now is simply this: ⭐️ Let’s grab every opppotunity we have to influence the content of these Bills as they develop. #kingsspeech #ASB #ukhousing #victims

An enlightening presentation by Constable Michelle and DV Liaison Officer Chantha from Ryde Police Area Command (pictured with yours truly on the left and Epping Rotary President Ian Bittner on the right) at a recent Epping Rotary meeting. The statistics presented were shocking, as were the details of just how much reponsibility, accountability and resourcing is expected from the already stretched police to try to make a difference in this completely fraught societal problem. It seems the police are held to more account than the perpetrators. Thankfully, the laws are gradually tightening, including pending Coercive Control legislation, but it is an incredible uphill battle to reduce the devastating impact and cost DV has on families and society as a whole. When I was on the board of Bendigo Community Bank Epping, we provided financial support to The Northern Centre, a local organisation operating at the coal face of this incidious problem, with their SafeT program. Through my Thriving Communities™️ events, we facilitated the establishment of a free weekly pro bono legal clinic for victims through a local law firm, that has been running for years now. There is so much more to be done, locally, state-wide, nationally and globally. Currently collaborating with my cyrius senior creative team on campaign ideas to reach into the minds of perpetrators and get them to think twice before going down this terribly destructive path. #domesticviolence #coercivecontrol #NSWpolice #rotary #communitysafety

#unity The recent surge in mindless violence and thuggish behavior in our communities is nothing short of disgraceful. When individuals attack the very people sworn to protect us, they not only damage our country but also undermine the fabric of our society. This appalling behavior is a mockery of decency and civility, and those who partake in or encourage such acts should be the first to leave this nation they claim to protect. It's unfathomable what makes these actions appealing to some. Watching or encouraging violence, vandalism, and chaos reveals a deep-seated disregard for community and order. It's an irony that those who shout for others to "get out of England" are often the very ones who contribute the least to its betterment and the most to its decline. Living in Britain should be a source of pride and encouragement which our construction sector are seeking to achieve in the community developments we create, Yet, how can it be seen as such when these violent spectacles are allowed to continue? Social media, which holds so much potential for positive connection and communication, however, is too often misused and now become a tool for organising destructive gatherings and spreading harmful messages, making it far too easy for chaos to take hold. We must reclaim our streets, respect our communities, and keep our sense of pride. Those who truly care about this country must stand down from this tide of violence and disorder, showing that the Britain we want is one of respect, safety, and unity. It’s time to hold those responsible accountable and ensure that such disgraceful behavior is neither encouraged nor tolerated. Fast track new prisons if needs be and punish this disrespectful behaviour and stop being at war with ourselves. "United Kingdom" / "Great Britain" or are we heading towards "The Kingdom of Britain" as its neither united or Great with actions like this!!
