It’s unfortunate that some lawyers I have opposed (including several City of Toronto #employmentlaw litigators) have been unable to apply these important skills in their practice. law is not about bullying and menacing opposing parties into defeat. The second litigation becomes personal for lawyers is the second a tremendous disservice is done to their client. Abusive litigation tactics do not save client(s) money and it only backlogs courts/tribunals because opposing parties will NOT tolerate abuse and will choose to fight instead. As the old saying goes, you can’t fight fire with fire and expect to win. the BEST lawyers I have opposed in an adversarial capacity have been able to bring calm, patience, and respect to litigation and any negotiations achieving justice not only for their client but also vulnerable adversaries AND the court system because it cuts delay.
