In addition to his recent sit down with Charlie Baker, Chuck Todd of Meet the Press also discussed the current state of college athletics with Senators Corey Booker and Richard Blumenthal. As always, #NIL was a topic and Booker and Blumenthal discussed their draft bill that would preempt state NIL laws. But as both Senators acknowledged, the legal issues currently facing college athletics go well beyond NIL. Booker went so far as to say college athletics is “in crisis.” Which is one of the NCAA’s talking points. But college athletics as an entity is doing great. Fan interest and tv viewership are up. And the revenue being produced is at an all time high, with an additional billion per year coming into the system just from the expanded College Football Playoff. What Booker should have said is that the current model is in crisis. A model that heavily relies on the labor of FBS football players and Division I basketball players to fund the entire system (including orbitant salaries for many), but prohibits those athletes from directly sharing in the revenue they produce is no longer tenable, both legally and morally. College athletics will be fine. Great recitation of powerful actors in college athletics absolving themselves of any responsibility for the total and shameless commodification of a virtuous pursuit: human development through sports tethered closely to the mission of higher education. University presidents and chancellors, their hired mercenaries in greed (conference commissioners), athletic directors , and head coaches all own responsibility for the current mess of affairs in NCAA sports. Television networks aid and abet the powers that be by supplying insane amounts of money into their coffers, but that is not only expected, it is their duty as profit maximization corporations to do so. University presidents and chancellors are CEO's of nonprofit higher education institutions with a totally different and often public mission (public, land grant institutions). In reality there is no scarcity of resources in major college sports, only an abundance of greed. Only the independent Knight Commission on Intercollegiate Athletics has been outspoken and proactive on course correction. The powers that be would be wise to heed the recommendations of the Knight Commission and to the timeless and pertinent wisdom of 19th century British politician Lord Acton: "All power tends to corrupt and Absolute Power corrupts absolutely." #knightcommission #NCAA #greedkills #putstudentathletesfirst #highereducationmatters #coursecorrectnow

This year’s symposium theme was “The College Athlete: More Than a Marketplace.” Arthur’s panel was entitled “For Love AND Money—Balancing Equity, Opportunity, and Compensation in College Sports” and also included Jane McManus, Jeffrey Kessler, Michele Roberts, and Brittney Whiteside. During the program, Arthur and his co-panelists shared insightful information about numerous matters impacting today’s college athletes. Questions discussed included: • How does the legal landscape affect college athletes’ rights? • What is the future of NCAA governance? • What are the implications of collective bargaining or employee status? • What is the future for NIL policy in college athletics?
