We had an interesting online discussion this afternoon with former GC judge Ian Forrester KC, Dr Adam Scott OBE TD from CAT and Prof. Francisco Marcos Fernandez from IE Madrid, as to whether we need a specialized competition Tribunal at EU level, at the kind invitation of Wolters Kluwer and Valentin Mircea. To sum up my (strictly personal) view, it is a “no, but…” answer. Details in the ppt attached for those interested.

Francois Tulkens & Jonathan Renaux will be speaking at the Commission Université Palais (CUP) on the 24th of May 2024 (in Liège) and on the 7th of June 2024 (in Charleroi). The subject of these conferences will be the latest news on constitutional litigation. More specifically, they will discuss the latest developments regarding the effects of the Belgian Constitutional Court’s decisions. Very good summary and strong opinion by Dr. Michael Wallinger on a decision by the Paris Central Division of the UPC. This decision may indeed invite defendants to use the Central Division, through a subsidiary company, for the filing of their revocation action and hoping (note that this is not risk-free!) that the Local Division will wait with its infringement decision until the Central Division has adjudged validity. Alternatively, defendants could try to have two bites of the apple, i.e. by filing a counterclaim for revocation at the Local Division *and*, through a subsidiary or a straw man company, a revocation action at the Central Division. Great for attorneys, but will it also help to achieve the UPC’s goal to render, as a rule, high quality decisions on infringement and validity within one year per instance? It will be interesting to see how this case develops further. The CFI’s bizarrely complex structure may invite parties to play all sorts of procedural games in the beginning, but the court can certainly discourage them from doing so, if it so wishes. #UPC #UPCnugget #EPLIT

On July 4, 1776, the Continental Congress adopted the Declaration of Independence. Some cool facts: 🇺🇸 Primary author: Thomas Jefferson (33 years old) 🇺🇸 Key contributors: John Adams (40) and Benjamin Franklin (70) 🇺🇸 56 delegates signed, representing 13 colonies 🦅 Oldest signer: Benjamin Franklin (70) 🦅 Youngest signer: Edward Rutledge (26) 🇺🇸 Average age of signers: 44 The document took about two weeks to draft and several months to gather all signatures. It stands as a testament to the founders' vision and courage. Writing timeline: Writing process: 🇺🇸In June 1776, the Continental Congress appointed a committee to draft a declaration of independence from Great Britain. 🇺🇸The committee consisted of five members: John Adams, Benjamin Franklin, Thomas Jefferson, Robert Livingston, and Roger Sherman. 🇺🇸Thomas Jefferson was chosen to be the primary author, with input and edits from the committee. 🇺🇸Jefferson wrote the initial draft in about two weeks. 🇺🇸The committee and Congress made revisions to Jefferson's draft. 🇺🇸On July 4, 1776, Congress officially adopted the Declaration of Independence.
