📢 CAIDP Advises US Congress on Privacy Legislation, Focuses on Need to Strengthen AI Provisions In a statement issued in advance of a meeting in Congress to consider the American Privacy Rights Act, the Center for AI and Digital Policy urged US lawmakers to strengthen key provisions concerning AI systems. As CAIDP explained, "We support this long-awaited step towards a federal privacy law. This work is urgent given the growing risks to public safety and civil liberties. Many AI systems rely on the collection of personal data. These systems diminish privacy and are used for mass surveillance. AI systems pose new challenges for privacy, dignity, autonomy, and equality." CAIDP made several recommendations: 1️⃣ Restore the Civil Rights safeguards for AI systems and the definition of "covered algorithm" that were in the original privacy legislation 2️⃣ Expand the definition of biometric data so that it aligns with the Federal Trade Commission definition 3️⃣ Make clear that Privacy Enhancing Technologies (PETs) refer specifically to techniques that "minimize or eliminate" the collection and use of personal data 4️⃣ Ensure that a federal privacy law establishes a national baseline and does not preempt stronger state safeguards #apra #aigovernance Marc Rotenberg Merve Hickok Christabel R. As 2024 begins to gather shape, a few trends are becoming apparent in the privacy (and AI) world: - No general federal privacy legislation since last year - New Hampshire SB 255 is still poised to be the next general state privacy bill signed (and the 14th overall) - Uptick in CIPA litigation - No abatement in data breach litigation - 2nd announced CCPA enforcement action by the Cal AG - CPRA regs are enforceable (again), but petitioned to the California Supreme Court - Connecticut AG publishes report on the first 6 months of CTDPA - Uptick in AADC (age appropriate design code) bills - My Health My Data Act goes "live" on March 31, 2024 - Oregon and Texas general privacy bills go live on July 1, 2024 - AI bills beginning to take shape (above/beyond forming a commission to study the risks). On May 9th, Maryland became the 17th state to enact a comprehensive data privacy law, the Maryland Online Data Privacy Act (MODPA). While similar to GDPR and other state data privacy laws, MODPA goes further to restrict companies from collecting, processing, or sharing sensitive data entirely, except where "strictly necessary to provide or maintain a specific product or service requested by the consumer." This presents a significant challenge to the AI because AI often entails gathering and scrutinizing extensive datasets. Lots of interesting takeaways from the #OPC's 2023-2024 annual report. In addition to the strategic priorities, a few other elements that stood out for me are: 1. While the number of #databreaches reported in 2023-2024 is stable compared to the 2022-2023 numbers, the amount of affected accounts has more than doubled, indicating that incidents are getting bigger and impacting more and more individuals. 2. Ongoing active investigations conducted in collaboration with provincial regulators highlight the ongoing regulatory interest in privacy issues related to #AI and #socialmedia. 3. 46% of all breaches reported to the OPC were identified as #cyberincidents — this further demonstrates the importance for businesses to consider their #cybersecurity measures and take proactive steps to mitigate the impact of a #cyberattack. 4. Finally, the OPC is planning to launch a #RROSH assessment tool in the coming year, which should be interesting for all #privacy practitioners in determining significant harm.
