Do people really confuse legal with compliance? Is the duty of ensuring compliance solely within the purview of Compliance Officers and entirely off the table for Legal Officers? Not long ago, I came across a compelling post that claimed many often confuse #legal and #compliance roles. The post suggested that the compliance function should be designated only to the compliance team, not the legal team. As someone who's had the opportunity of handling compliance tasks within a legal team, I felt inspired to chime in. Here's my perspective: The allocation of compliance duties can vary widely from one organization to another. In larger, heavily regulated organizations, it's often the case that legal and compliance are separated. However, in smaller organizations (size not necessarily reflecting turnover), it's quite common for the legal team to assume compliance responsibilities. I would, therefore, not equate the blending of these roles to confusion but instead consider it a reflection of an organization's structure and specific needs. While these roles are separate, they can be managed by a single department depending on the circumstances. Compliance officers ensure day-to-day adherence to regulations, while legal officers offer guidance on complex legal issues, represent the organization in legal disputes, and help design compliance programs. As a small business owner, in an industry that now requires a lot of compliance regulation, how do we afford the services we need to stay informed and follow the rules and regulations? For large companies, the solution is simple. Hire a full-time compliance officer and allow them to access a legal team as needed. The role is more important than ever, and having a dedicated person makes sense. So, how do small to medium sized businesses navigate this predicament? The expectations are the same, but the disparity in resources put smaller businesses at a disadvantage. One solution is to hire a part-time compliance officer or consultant.
